    Petitioner, a counsel who appeared for the<\/p>\n
first accused in C.C.No.44\/2009 on the file of<\/p>\n
Chief  Judicial  Magistrate’s  Court,   Thodupuzha,<\/p>\n
against whom, along with two others, Annexure-1<\/p>\n
complaint  was  filed  by  learned  Chief  Judicial<\/p>\n
Magistrate, Thodupuzha before Judicial First Class<\/p>\n
Magistrate-I, Thodupuzha and taken cognizance of<\/p>\n
the offences under Sections 205, 467, 472, 473 and<\/p>\n
474 read with Section 34 of Indian Penal Code as<\/p>\n
C.C.No.540\/2010, filed this petition under Section<\/p>\n
482 of Code of Criminal Procedure to quash the<\/p>\n
proceedings contending that no enquiry as provided<\/p>\n
under Section 340 of Code of Criminal Procedure was<\/p>\n
conducted and petitioner was not served with a<\/p>\n
notice in Form No.33 of Appendix-I of Criminal<\/p>\n
Rules  of   Practice  and   therefore,   Annexure-1<\/p>\n
complaint filed should not have taken cognizance by<\/p>\n
CRMC 2996\/10             2<\/span><\/p>\n
the learned Magistrate.\n<\/p>\n
    2. Learned counsel appearing for the petitioner<\/p>\n
and learned Public Prosecutor were heard.<\/p>\n
    3.    Entire records in   C.C.No.540\/2010  were<\/p>\n
called for. As it does not disclose the details of<\/p>\n
the enquiry, if any, conducted under Section 340 of<\/p>\n
Code of Criminal Procedure, records in C.C.No.<\/p>\n
44\/2009 were also called for. The proceedings paper<\/p>\n
in C.C.No.44\/2009 reveals that on 15.6.2010, an<\/p>\n
application was filed by one of the sureties of the<\/p>\n
first accused therein, who is the second accused in<\/p>\n
Annexure-1 complaint, to substitute one of the<\/p>\n
sureties. The surety sought to be substituted filed<\/p>\n
documents. Learned Chief Judicial Magistrate, on<\/p>\n
perusing the documents, doubted that the document<\/p>\n
is forged. Statement of the proposed surety was<\/p>\n
recorded. When the matter was posted after lunch,<\/p>\n
first accused in C.C.No.44\/2009 did not attend the<\/p>\n
court. Learned Chief Judicial Magistrate remanded<\/p>\n
the proposed surety and issued summons to Sub<\/p>\n
Registrar, Mattanchery to be present along with the<\/p>\n
CRMC 2996\/10               3<\/span><\/p>\n
filing sheet of the settlement deed to conduct an<\/p>\n
enquiry. On 18.6.2010, surety produced his details<\/p>\n
in court. Sub Registrar was examined as CW1. The<\/p>\n
surety revealed his correct name. Summons was then<\/p>\n
issued to the Village Officer and the original<\/p>\n
surety, who executed the bond for the first accused<\/p>\n
in  C.C.No.44\/2009.   On   23.6.2010, learned  Chief<\/p>\n
Judicial Magistrate directed the first accused in<\/p>\n
C.C.No.44\/2009    to  be   present  along  with  the<\/p>\n
sureties and also petitioner, his Advocate. Then it<\/p>\n
was revealed that original surety was not genuine.<\/p>\n
Learned     Chief  Judicial  Magistrate,  therefore,<\/p>\n
passed an order directing filing of a complaint<\/p>\n
before      Judicial   First   Class   Magistrate-I,<\/p>\n
Thodupuzha. Accordingly, Annexure-1 complaint was<\/p>\n
filed.\n<\/p>\n
    4. It is thus clear from the proceedings paper<\/p>\n
in   C.C.No.44\/2009    that  though   learned  Chief<\/p>\n
Judicial Magistrate conducted an enquiry, it was<\/p>\n
not disclosed to the petitioner, who was appearing<\/p>\n
for the first accused in that case, whether an<\/p>\n
CRMC 2996\/10              4<\/span><\/p>\n
enquiry is being conducted under Section 340 of<\/p>\n
Code of Criminal Procedure and that too against the<\/p>\n
counsel     also. Though  in  Annexure-1  complaint<\/p>\n
learned Chief Judicial Magistrate recorded that she<\/p>\n
is of the opinion that it is expedient in the<\/p>\n
interest of justice that an enquiry should me made<\/p>\n
into   the   aforesaid offences  and  therefore,  a<\/p>\n
complaint is filed, before deciding to file a<\/p>\n
complaint, it was not recorded by the learned Chief<\/p>\n
Judicial Magistrate that it is expedient in the<\/p>\n
interest of justice to conduct an enquiry.<\/p>\n
    5. This Court in Babu P.Benedict v. Principal,<\/p>\n
Motor Accidents Claims Tribunal<\/a> (2010 (1) KLT 445)<\/p>\n
considered the question whether an enquiry under<\/p>\n
Section    340  of Code  of  Criminal Procedure  is<\/p>\n
mandatory and is it permissible for a court to take<\/p>\n
a final decision to make a complaint against a<\/p>\n
person who has committed an offence against public<\/p>\n
justice in the very same order, disposing of the<\/p>\n
main   proceedings.   Following  the  decisions  in<\/p>\n
Krishna Bhat v. Keshava Bhat<\/a> (1991 (1) KLT 72),<\/p>\n
CRMC 2996\/10             5<\/span><\/p>\n
Thomman v. II Additional Sessions Judge<\/a> (1993 (2)<\/p>\n
KLT 774) and Moideen Sha v. Joseph Mathew<\/a> (2007 (4)<\/p>\n
KLT 315), learned Single Judge held that in an<\/p>\n
enquiry, falling under Section 340 of Code of<\/p>\n
Criminal    Procedure,  which  is   affecting   the<\/p>\n
administration of justice, it is imperative to<\/p>\n
record a finding that it is expedient in the<\/p>\n
interest of justice to do so and it has to be after<\/p>\n
conducing a preliminary enquiry and in every case,<\/p>\n
where a criminal court proposes to conduct an<\/p>\n
enquiry under Section 340 of Code of Criminal<\/p>\n
Procedure, it has to issue notice in Form No.33 of<\/p>\n
Appendix-I of Criminal Rules of Practice, informing<\/p>\n
the person, sought to be proceeded against, that an<\/p>\n
enquiry will be held under Section 340 of Code of<\/p>\n
Criminal Procedure to determine whether a complaint<\/p>\n
should    be laid  against  him for  the   offences<\/p>\n
concerned and calling upon him to show cause why<\/p>\n
such a complaint should not be made. Even if it is<\/p>\n
taken that in a case, where the person, against<\/p>\n
whom a complaint is to be filed, is present in<\/p>\n
CRMC 2996\/10              6<\/span><\/p>\n
court and therefore, no notice as provided under<\/p>\n
Form No.33 of Appendix-I of Criminal Rules of<\/p>\n
Practice was served, it is imperative that an<\/p>\n
enquiry is proposed to be held under Section 340 of<\/p>\n
Code of Criminal Procedure against him to determine<\/p>\n
whether a complaint should laid against him for the<\/p>\n
concerned offences, he should be called upon to<\/p>\n
show cause why such a complaint should not be made.<\/p>\n
    6.    The  proceedings paper  in  C.C.No.44\/2009<\/p>\n
shows that no notice in Form No.33 of Appendix-I of<\/p>\n
Criminal    Rules of  Practice  was  served  on the<\/p>\n
petitioner or the other accused. So also, they were<\/p>\n
not informed that an enquiry as provided under<\/p>\n
Section    340  of Code  of  Criminal  Procedure is<\/p>\n
proposed to be conducted. They were also not called<\/p>\n
upon to show cause why a complaint should not be<\/p>\n
filed     against  them.   In  such   circumstances,<\/p>\n
Annexure-1    complaint   filed  by  learned   Chief<\/p>\n
Judicial Magistrate, without conducting an enquiry<\/p>\n
as provided under Section 340 of Code of Criminal<\/p>\n
Procedure    and  following   the  procedureprovided<\/p>\n
CRMC 2996\/10              7<\/span><\/p>\n
therein, is illegal and based on that complaint,<\/p>\n
Judicial    First  Class  Magistrate-I,   Thodupuzha<\/p>\n
should not have taken cognizance of the offences.<\/p>\n
     Petition is allowed. The cognizance taken in<\/p>\n
C.C.No.540\/2010 on Annexure-1 complaint is quashed.<\/p>\n
Chief Judicial Magistrate, Thodupuzha is directed<\/p>\n
to conduct an enquiry under Section 340 of Code of<\/p>\n
Criminal Procedure against the proposed accused,<\/p>\n
including the petitioner, after serving a notice in<\/p>\n
Form No.33 of Appendix-I of Criminal Rules of<\/p>\n
Practice and thereafter pass an order in compliance<\/p>\n
with the provisions of Section 340 of Code of<\/p>\n
Criminal     Procedure.   Judicial    First    Class<\/p>\n
Magistrate-I,   Thodupuzha  is  competent  to   take<\/p>\n
cognizance of the offences on such a complaint<\/p>\n
being filed, complying with the procedure provided<\/p>\n
under the Code.\n<\/p>\n
