Shah, learned advocate for the petitioner.\n<\/p>\n<p>2.<br \/>\nThe petitioner is aggrieved by the letter\/communication dated<br \/>\n21.9.2010.\n<\/p>\n<p>3.<br \/>\nBy the said letter\/communication, which is also  in form of an order<br \/>\npassed by the respondent No.3, the petitioner is now sought to be<br \/>\nplaced under           non-technical post and his salary is sought to<br \/>\nbe    re-fixed which would adversely affect the petitioner. The<br \/>\npetitioner has sought to challenge the said letter\/communication on<br \/>\nthe ground that there is no justification of reverting him i.e.<br \/>\nplacing him under non-technical post and that the order has been<br \/>\npassed without hearing the petitioner.\n<\/p>\n<p>4.<br \/>\nThe petition is sought to be preferred by invoking provision under<br \/>\nthe Industrial Disputes Act, 1947 (hereinafter referred to as the<br \/>\n&#8220;Act&#8221;). If the petitioner intends to invoke provision<br \/>\nunder the Act then the issues involved\/raised will have to be decided<br \/>\nin light of evidence and after adjudication process hence petitioner<br \/>\nought to pursue statutory alternative remedy provided under the Act<br \/>\nand approach the appropriate forum with his grievance. On the other<br \/>\nhand if the petitioner seeks to challenge the said order passed by a<br \/>\nstatutory Board, then the petitioner would have to file appropriate<br \/>\npetition i.e. not under I.D. Act or take out other proceeding<br \/>\nchallenging the said order. The present petition invoking the<br \/>\nproceedings under the I.D. Act challenging the said<br \/>\nletter\/communication cannot be entertained. The Counsel has, thus,<br \/>\nsubmitted that the petitioner will prefer appropriate proceedings<br \/>\nincluding appropriate writ proceedings.\n<\/p>\n<p>5.<br \/>\nThe present petition is disposed of only on the aforesaid ground<br \/>\nwithout going into the merits of the order. It would be open to the<br \/>\npetitioner to approach appropriate forum as may be considered<br \/>\nappropriate in the facts of the case.
