Ratan Purvey\n                                            --------------- Opposite Parties\n                                           ----------\n<\/pre>\n<p>3.   11-11-2011              This is an application for quashing the<\/p>\n<p>                  order dated 14.7.2006 passed by Sri R.K.Singh,<\/p>\n<p>                  Judicial      Magistrate,           1st      Class,      Rosera,<\/p>\n<p>                  Samastipur in C.R. 235 of 2004, T.R. 109 of<\/p>\n<p>                  2008 by which he arrayed the petitioners as<\/p>\n<p>                  accused persons in this case and they have been<\/p>\n<p>                  put on trial along with other accused persons<\/p>\n<p>                  under section 319 of the Cr.P.C.\n<\/p>\n<p>                             Heard counsel for the parties.\n<\/p>\n<p>                             Brief    fact     of    the Complaint        Case     is<\/p>\n<p>                  that complainant and accused persons are sons<\/p>\n<p>                  of late Ramotar Purbey who had five sons. For<\/p>\n<p>                  accused no.1 it is said that he fraudulently<\/p>\n<p>                  succeeded to get a gift deed executed by late<\/p>\n<p>                  Ramotar Purbey in favour of his wife (accused<\/p>\n<p>                  no.2) in conspiracy with petitioners and one<\/p>\n<p>                  Awadhesh      Lal     Karn        (accused      no.5).       After<\/p>\n<p>                  examination         of       complainant          on         solemn<\/p>\n<p>                  affirmation        and     his     witnesses       in    enquiry<\/p>\n<p>                  cognizance      was      taken     in     the   case     against<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>accused nos. 1 and 2 only against whom summons<\/p>\n<p>were      issued,         trial        commenced,          witnesses<\/p>\n<p>examined in the case before charge. In that<\/p>\n<p>course    a     petition       was      filed       on    behalf      of<\/p>\n<p>complainant-opposite            party        no.2    on    27.4.2005<\/p>\n<p>under    section         319   Cr.P.C.       before        the      trial<\/p>\n<p>court. Same was opposed on behalf of defence<\/p>\n<p>but petition filed on behalf of complainant-<\/p>\n<p>opposite party no.2 is allowed by order dated<\/p>\n<p>27.4.2005 arraying petitioners along with one<\/p>\n<p>Awadhesh Lal Karn as accused in the case and<\/p>\n<p>summons       are    issued.      It    is    made        clear     that<\/p>\n<p>accused       no.1   Shambhunath         Purbey          and   accused<\/p>\n<p>no.5 Awadhesh Lal Karn are dead now.<\/p>\n<pre>          Submission            advanced             by        counsel\n\nappearing       on    behalf      of    petitioners            is    that\n\n<\/pre>\n<p>under section 319 persons &#8220;not being accused in<\/p>\n<p>the case&#8221; can only be summoned while in instant<\/p>\n<p>case petitioners were named in the complaint<\/p>\n<p>petition, in full-fledged inquiry no liability<\/p>\n<p>could be fixed upon them after considering the<\/p>\n<p>statement      of    complainant-opposite                 party     no.2<\/p>\n<p>and     his    witnesses          examined      in        course      of<\/p>\n<p>enquiry. His further submission is that once<\/p>\n<p>they     (petitioners)            are        made        accused       in<\/p>\n<p>complaint petition it would amount that they<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>were accused in the case and not coming in the<\/p>\n<p>expression \u201enot being the accused\u201f. Section 319<\/p>\n<p>Cr.P.C. runs as follows:\n<\/p>\n<blockquote><p>               &#8220;319. Power to proceed against<br \/>\n        other persons appearing to be guilty<br \/>\n        of offence.-(1) Where, in the course<br \/>\n        of any inquiry into, or trial of, an<br \/>\n        offence, it appears from the evidence<br \/>\n        that any person not being the accused<br \/>\n        has committed any offence for which<br \/>\n        such person could be tried together<br \/>\n        with the accused, the Court may<br \/>\n        proceed against such person for the<br \/>\n        offence which he appears to have<br \/>\n        committed.&#8221;<\/p><\/blockquote>\n<p>          It is admitted to the parties that the<\/p>\n<p>only persons &#8220;not being the accused&#8221; can be<\/p>\n<p>summoned       under   section       319   Cr.P.C.     Further<\/p>\n<p>admission is that till submission of charge<\/p>\n<p>sheet no person can be said accused in Police<\/p>\n<p>case,     controversy         is     in    cases   filed       on<\/p>\n<p>complainant petition.\n<\/p>\n<pre>          In     Complaint         Case    as   appeared      in\n\ninstant    case,       case    was    made      over   to    the\n\n<\/pre>\n<p>concerned Magistrate for inquiry under section<\/p>\n<p>192 Cr.P.C. arraying petitioners also accused<\/p>\n<p>but no summons or warrant was issued against<\/p>\n<p>these petitioners and section 319 Cr.P.C. is<\/p>\n<p>clear enough that person or persons against<\/p>\n<p>whom    relief    is    sought      for    proceeding       their<\/p>\n<p>trial with accused facing trial, in inquiry or<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>            trial should not be accused, so there appears<\/p>\n<p>            difference       in    between      the    cases     filed     as<\/p>\n<p>            Police    Case        and   cases     on     complaint.        In<\/p>\n<p>            complaint cases if some one is made accused in<\/p>\n<p>            complaint petition and on inquiry as in the<\/p>\n<p>            instant case no summons is issued &#8220;not being<\/p>\n<p>            the accused&#8221; comes to an end. This view finds<\/p>\n<p>            support from the cases reported in AIR 1990<\/p>\n<p>            Supreme Court 2158 (Sohan Lal &amp; Ors. Vs State<\/p>\n<p>            of Rajasthan) and 2004(1) PCCR 21 (Rama Devi<\/p>\n<p>            and anr. vs. The State of Bihar and anr.). In<\/p>\n<p>            clear    words    it    comes    that      petitioners       were<\/p>\n<p>            made     accused       against       whom      inquiry       was<\/p>\n<p>            conducted and no summons was issued amounts<\/p>\n<p>            equivalent to their discharge, so they cannot<\/p>\n<p>            be summoned under section 319 Cr.P.C.<\/p>\n<p>                     Thus, the application for quashing is<\/p>\n<p>            allowed and the impugned order dated 14.7.2006<\/p>\n<p>            passed in C.R.235 of 2004, T.R.109 of 2008 is<\/p>\n<p>            hereby quashed.\n<\/p>\n<\/p>\n<p>                                                       ( Mandhata Singh, J.)<br \/>\nAI\/   AFR\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Parmanand Jayaswal &amp; Anr vs State Of Bihar &amp; Anr on 11 November, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.41500 of 2008 1.
