THE DISTRICT TREASURY OFFICER SUPAUL\n                                          -----------\n<\/pre>\n<p>2.   23.11.2010                Heard learned counsel for the petitioner and<\/p>\n<p>                  the State.\n<\/p>\n<p>                               The petitioner is stated to be a Clerk in the<\/p>\n<p>                  District Land Acquisition Department, Supaul.          His<\/p>\n<p>                  son is stated to be suffering from Cancer, and is<\/p>\n<p>                  undergoing treatment at the Tata Memorial Hospital at<\/p>\n<p>                  Bombay and which it is stated has saved his life. The<\/p>\n<p>                  petitioner with his little means has incurred heavy<\/p>\n<p>                  expenses and submitted bills for reimbursement. On<\/p>\n<p>                  6.5.2008, the Deputy Director, Revenue and Land<\/p>\n<p>                  Reforms       Department      addressed    the     District<\/p>\n<p>                  Magistrate, Supaul acknowledging the submission of<\/p>\n<p>                  bills   and    necessary   papers   but   sought   certain<\/p>\n<p>                  clarification and further information. This was replied<\/p>\n<p>                  to by the District Magistrate on 23.9.2008 with all<\/p>\n<p>                  necessary information.         The Revenue and Land<\/p>\n<p>                  Reforms Department then forwarded all papers to the<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>Superintendent of Patna Medical College and Hospital<\/p>\n<p>for cross verification.        The hospital confirmed the<\/p>\n<p>correctness of all documents and bills quantified at<\/p>\n<p>Rs.    8,80,947\/-       but   approved   payment    of   Rs.<\/p>\n<p>8,31,418\/-.     Learned counsel for the petitioner<\/p>\n<p>submits that notwithstanding the passage of nearly<\/p>\n<p>more than one and a half years, the actual payment<\/p>\n<p>still remained elusive. The petitioner is already under<\/p>\n<p>crushing burden of further ongoing treatment of his<\/p>\n<p>son.\n<\/p>\n<p>          Counsel for the State prays for time to seek<\/p>\n<p>instruction.\n<\/p>\n<p>          The urgency of life cannot succumb to<\/p>\n<p>Government indolence.            If the petitioner is not<\/p>\n<p>reimbursed with the legitimate dues it need no<\/p>\n<p>emphasis that given the serious aliment that the son<\/p>\n<p>is suffering from matters could turn to his grave and<\/p>\n<p>irreparable prejudice.        Insensibility on part of those<\/p>\n<p>concerned harping procedures does not appeal to the<\/p>\n<p>Court.\n<\/p>\n<p>          This Court directs the Principal Secretary,<\/p>\n<p>Revenue and Land Reforms Department to forthwith<\/p>\n<p>examine matters and pay the legitimate dues of the<\/p>\n<p>petitioner as medical reimbursement in accordance<\/p>\n<p>with law within a maximum period of four weeks from<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>           the date of receipt\/ production of a copy of this order.<\/p>\n<p>                     It is apparent from the communications of<\/p>\n<p>           the Deputy Secretary dated 30.5.2009, of the District<\/p>\n<p>           Magistrate dated 23.9.2008 and of the Patna Medical<\/p>\n<p>           College   and   Hospital   dated30.5.2009       that   the<\/p>\n<p>           petitioner has submitted necessary documents in his<\/p>\n<p>           possession and which have all been examined. If the<\/p>\n<p>           Principal Secretary desires any further information it<\/p>\n<p>           shall be his obligation and duty to ensure availability<\/p>\n<p>           of the documents from the concerned sources of<\/p>\n<p>           treatment, at the expense of the State Government so<\/p>\n<p>           that the legitimate dues are positively paid within the<\/p>\n<p>           period indicated by the Court. The petitioner cannot<\/p>\n<p>           be called upon to furnish any further documentary<\/p>\n<p>           evidence from the Tata Memorial Hospital, in view of<\/p>\n<p>           the report of the Patna Medical College and Hospital<\/p>\n<p>           dated 30.5.2009.\n<\/p>\n<p>                     It is expected that the urgency and the need<\/p>\n<p>           for sensibility of human life are aspects which shall<\/p>\n<p>           not be overlooked by the Principal Secretary.<\/p>\n<p>                     The writ application stands allowed.<\/p>\n<pre>P.
