KRISHNAN, J.\n                  ...........................................\n                  M.A.C.A.No.2267 OF 2009\n                 .............................................\n            Dated this the 27th day of January, 2010.\n\n                        J U D G M E N T\n<\/pre>\n<p>     This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Neyyattinkara in OP(MV)No.1893\/2003. A<\/p>\n<p>man, who had sustained some injuries over the chin and<\/p>\n<p>fracture of the two incisor teeth, had moved an application<\/p>\n<p>for compensation under Section 163 A of the Motor Vehicles<\/p>\n<p>Act. It is true that question of negligence pales in to<\/p>\n<p>insignificance. But when it is a claim made under that<\/p>\n<p>section in order to enable a person to get compensation<\/p>\n<p>either it must have resulted in death or permanent<\/p>\n<p>disablement and explanation to Section 163 A very clearly<\/p>\n<p>speaks that permanent disability shall have some meaning<\/p>\n<p>and extent as in the Workmen&#8217;s Compensation Act, 1923.<\/p>\n<p>Section 2(l) of Workmen&#8217;s Compensation Act deals with total<\/p>\n<p>disablement. Total disablement means such disablement,<\/p>\n<p>whether of a temporary or permanent nature, as incapacitates<\/p>\n<p>a workman for all work which he was capable of performing<\/p>\n<p>at the time of the     accident resulting in such disablement.<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nM.A.C.A.No.2267 OF 2009<\/p>\n<p>So, it is the type of disablement that is expected under the<\/p>\n<p>provisions of the Workmen&#8217;s Compensation Act. Section 2(g)<\/p>\n<p>deals with partial disablement relates to affecting of the<\/p>\n<p>working capacity of the individual. Here is a case where the<\/p>\n<p>claimant has sustained fracture of two incisors. Even when<\/p>\n<p>there is    loss of  an incisor,   this Court   considering the<\/p>\n<p>question under Section 140 of the Motor Vehicles Act in the<\/p>\n<p>decision reported in <a href=\"\/doc\/277441\/\">United India Insurance Co. Ltd. v.<\/p>\n<p>Thomas<\/a> (200 (1) KLT 516), it will not amount to permanent<\/p>\n<p>disability . Therefore fracture of a tooth will not in any way<\/p>\n<p>affect the working capacity of a person so as to attract<\/p>\n<p>compensation under Section 163 A.\n<\/p>\n<p>      2. The learned counsel very strongly contends before<\/p>\n<p>me that     disability is there on account of the recurrence<\/p>\n<p>attack of headache and vertigo. The learned counsel in<\/p>\n<p>fairness had given a copy of the disability certificate and I<\/p>\n<p>am surprised to see that the doctor just on examination<\/p>\n<p>mentioned recurrent attack of headache and vertigo. No<\/p>\n<p>radiological examination is      done. Nothing is there      to<\/p>\n<p>establish this and not even a scrap of paper is produced to<\/p>\n<p><span class=\"hidden_text\">                             : 3 :<\/span><br \/>\nM.A.C.A.No.2267 OF 2009<\/p>\n<p>show the follow up treatment. The doctor is also examined<\/p>\n<p>in this case. Just because a disability certificate is produced<\/p>\n<p>the Tribunal shall not ipso facto jump    to the     conclusion<\/p>\n<p>regarding the correctness of the same especially when the<\/p>\n<p>injury sustained is only fracture of the two incisor and<\/p>\n<p>nothing else.\n<\/p>\n<p>      Therefore I find that the award passed by the Tribunal<\/p>\n<p>under Sections 163 A is quite unwarranted and it requires<\/p>\n<p>interference. The appeal is allowed and the claim petition is<\/p>\n<p>dismissed. No    costs. If  any amount is deposited by the<\/p>\n<p>insurance company let it be reimbursed to the insurance<\/p>\n<p>company on appropriate application.\n<\/p>\n<\/p>\n<p>                                  M.N.
