GOVERNMENT PLEADER for\nRespondent(s) : 1, \nNOTICE SERVED for Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 09\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tHeard learned<br \/>\nCounsel for the parties, for the final disposal of the petition.\n<\/p>\n<p>2.\t\tPetitioner is<br \/>\naggrieved by an order dated 27.08.2010, passed by the Chief<br \/>\nController Revenue Officer, Gandhinagar, whereby the appeal of the<br \/>\npetitioner was not entertained on merits, considering it as time<br \/>\nbarred.\n<\/p>\n<p>3.\t\tPetitioner, before<br \/>\nthe appellate authority, challenged an order dated 28.04.2010, passed<br \/>\nby the Deputy Collector, demanding additional stamp duty of<br \/>\nRs.4,73,297\/-, on a Sale Deed executed in favour of the petitioner.<br \/>\nPetitioner, therefore, preferred appeal against the said order, on<br \/>\n28.07.2010. He also deposited 25 per cent of the disputed stamp duty.\n<\/p>\n<p>4.\t\tIt is the case of<br \/>\nthe petitioner that the appeal was not belated. It was filed within<br \/>\n90 days, from the date of the order under challenge in the appeal.<br \/>\nIn any case, it was well within 90 days, from the date of the<br \/>\ncommunication of the order.  The petitioner had also, by way of<br \/>\nabundant caution, prayed for the condonation of delay.\n<\/p>\n<p>5.\t\tI am, therefore, of<br \/>\nthe opinion that the appellate authority ought to have considered the<br \/>\nappeal of the petitioner, on merits.  Primarily, it was not beyond 90<br \/>\ndays, considering from the date of receipt of communication.  At the<br \/>\nvery worst, it was a delay of one day. Such a substantial right of<br \/>\nthe petitioner, of appeal, ought not have been denied, only on the<br \/>\nground of limitation.\n<\/p>\n<p>6.\t\tIn the result,<br \/>\nimpugned order dated 27.08.2010, passed by the Chief Controller<br \/>\nRevenue Officer, Gandhinagar, is SET ASIDE.  The<br \/>\nappellate authority shall ENTERTAIN the appeal of the<br \/>\npetitioner on MERITS and dispose of the same, in<br \/>\naccordance with law.
