Opposite Party.\n                               -----------\n<\/pre>\n<p>2   18.11.2010        Heard     learned      counsel       appearing       on<\/p>\n<p>                 behalf   of   the    petitioner     and    the    learned<\/p>\n<p>                 counsel appearing on behalf of the State.<\/p>\n<p>                      Petitioner is in custody in connection<\/p>\n<p>                 with Kurhani P.S. Case No. 173 of 2010 for<\/p>\n<p>                 the offence punishable under Sections 379\/511<\/p>\n<p>                 of the Indian Penal Code.\n<\/p>\n<p>                      Taking          into     consideration              the<\/p>\n<p>                 submissions of the learned counsel that for<\/p>\n<p>                 the alleged offence of attempting to commit<\/p>\n<p>                 theft, the petitioner has remained in custody<\/p>\n<p>                 since 01.08.2010, let the petitioner namely<\/p>\n<p>                 Govind     Tiwary     be    released      on     bail     on<\/p>\n<p>                 furnishing    bail    bonds   of    Rs.10,000\/-         (ten<\/p>\n<p>                 thousand)     with    two   sureties      of   the      like<\/p>\n<p>                 amount each to the satisfaction of the Chief<\/p>\n<p>                 Judicial       Magistrate          Muzaffarpur,           in<\/p>\n<p>                 connection with Kurhani P.S. Case No. 173 of<\/p>\n<p>                 2010, subject to the following conditions.<\/p>\n<p>                   1. that the father of the petitioner would<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>               stand   as    one    of       the    bailors      and   who<\/p>\n<p>               would   be    under       a    duty to       inform     the<\/p>\n<p>               court   below       in    case       this    petitioner<\/p>\n<p>               after his release in the present case<\/p>\n<p>               is named or is found involved in any<\/p>\n<p>               further      case    of       similar       nature      and<\/p>\n<p>               whereupon the court below shall be at<\/p>\n<p>               liberty to cancel the bail bond of the<\/p>\n<p>               petitioner and take him into custody on<\/p>\n<p>               grounds of misuse.\n<\/p>\n<p>          2.    that the petitioner would ensure his<\/p>\n<p>               representation        before         the    Court    below<\/p>\n<p>               on each and very date fixed in the case<\/p>\n<p>               and   the    failure          on    the    part    of   the<\/p>\n<p>               petitioner to ensure his representation<\/p>\n<p>               on two consecutive dates fixed without<\/p>\n<p>               reasonable          explanation               to        the<\/p>\n<p>               satisfaction of the court below, would<\/p>\n<p>               confer liberty on the Court concerned<\/p>\n<p>               to initiate proceeding for cancellation<\/p>\n<p>               of his bail bonds and to take him into<\/p>\n<p>               custody.\n<\/p>\n<\/p>\n<p>                                              (Jyoti Saran, J.)<br \/>\nPrakash\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Govind Tiwary vs The State Of Bihar on 18 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
