Saxena\n\nHon'ble Sanjay Misra,J.\n<\/pre>\n<p>Heard Sri G.K. Singh learned counsel for the petitioners and Sri<br \/>\nY.K. Saxena learned counsel for the respondents.\n<\/p>\n<p>The petitioner is aggrieved by the election of the Committee of<br \/>\nManagement of the society by the name of Bhartiya Shiksha Sadan<br \/>\nSamiti held in the year 2007 duly approved on 25.7.2007 by the<br \/>\nrespondent no. 2.\n<\/p>\n<p>According to Sri Y.K. Saxena now fresh election of the Committee<br \/>\nof Management has been held and the matter is pending before the<br \/>\nRegional Level Committee where the petitioner if he is aggrieved,<br \/>\nmay file his objections.\n<\/p>\n<p>Sri G.K. Singh has submitted that in so far as the present election<br \/>\nis concerned the same would be dependent upon the validity or<br \/>\ninvalidity of the earlier election held in the year 2007 and as such<br \/>\nthe Regional Level Committee should consider this plea made by<br \/>\nthe petitioner and also re-consider its order dated 24.7.2007 since<br \/>\nit has not decided the final list of members hence order dated<br \/>\n25.2.2006 still holds good.\n<\/p>\n<p>Having considered the submission of learned counsel for the<br \/>\nparties the submission of Sri G.K. Singh appears to have<br \/>\nsubstance.\n<\/p>\n<p>According to Sri Saxena learned counsel for the respondents one<br \/>\nof the grounds which requires consideration is that the petitioner<br \/>\nhas no locusstandi to maintain a challenge to the election, and<br \/>\nstates that the approval of the present election is pending before<br \/>\nthe Regional Level Committee headed by the Joint Director of<br \/>\nEducation, District Kanpur Region, Kanpur hence it would be<br \/>\nappropriate that while perusing the records of the present elections<br \/>\nhe may also take into account the grievance of the petitioner only<br \/>\nif he has locus standi relating to the election of the Committee of<br \/>\n Management Bhartiya Shiksha Sadan Samiti held in the year 2007<br \/>\nrelating to valid members more particularly because the dispute in<br \/>\nthis writ petition is of very seriously disputed questions of fact<br \/>\nregarding membership.\n<\/p>\n<p>Consequently this court in its writ jurisdiction will not be in a<br \/>\nposition to adjudicate such disputed questions of fact only on the<br \/>\nbasis of affidavits and the annexures which would be appropriately<br \/>\ndone by Regional Level Committee before whom the matter<br \/>\nappears to be pending and which can verify the documents<br \/>\nproduced by the parties.\n<\/p>\n<p>Consequently this writ petition is disposed of by requiring the<br \/>\nRegional Level Committee to consider the aforesaid grievance<br \/>\nraised by Sri G.K. Singh learned counsel for the petitioner and all<br \/>\nthe issues raised by Sri Y.K. Saxena learned counsel for the<br \/>\nrespondents including on the issue of locus standi. The impugned<br \/>\norder shall be subject to such decision taken by the Regional Level<br \/>\nCommittee.\n<\/p>\n<p>It is made clear that this court has not expressed its opinion on the<br \/>\nmerits of the claim made either by the petitioner or by the<br \/>\nrespondents and that has to be done by the Regional Level<br \/>\nCommittee.\n<\/p>\n<p>The writ petition stands disposed of as above.\n<\/p>\n<p>No order is passed as to costs.\n<\/p>\n<p>Order Date :- 9.8.2010<br \/>\nPravin\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Bhartiya Shiksha Sadan Samiti &#8230; vs State Of U.P.
