When the summons are served,  the defendant appeared<br \/>\n\tand submitted application Ex.10 to entitle him to defend the suit as<br \/>\n\tper the provisions of Order 37. Learned counsel raised the question<br \/>\n\tas to who will begin with the arguments in the suit and hence, the<br \/>\n\tCourt passed a reasoned order below Ex.1 in the above referred suit<br \/>\n\tand came to the conclusion that the plaintiff has to argue out Ex.7<br \/>\n\ti.e. summons for judgment first. Said order is challenged in this<br \/>\n\trevision.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel, Mr.N.A.Pandya for the applicants and learned<br \/>\n\tcounsel, Mr.Vishal Mehta, for the opponents.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Pandya, taking this Court through the relevant<br \/>\n\tprovisions of Order 37, has submitted that first of all Court has to<br \/>\n\tdecide whether unconditional or conditional leave to defend the suit<br \/>\n\tis required to be granted to the defendant or not and only then,<br \/>\n\tCourt can proceed with the suit. It is further submitted that<br \/>\n\tagainst the provisions of Order 37 Rule-3(6), learned Civil Court<br \/>\n\thas passed the order and hence in revision, this Court has<br \/>\n\tjurisdiction to interfere with the findings of the court below and<br \/>\n\trectify the mistake.\n<\/p>\n<p>On<br \/>\n\tthe other hand, it is submitted by learned counsel, Mr.Mehta, that<br \/>\n\tto prove the case, the learned advocate of the plaintiffs has to<br \/>\n\targue out by proceeding with the suit first. It is further submitted<br \/>\n\tthat after perusing the provisions of Order 37 Rule 3(6) of CPC and<br \/>\n\tSecs.101 and 102 of Indian Evidence Act, the learned Civil Judge has<br \/>\n\trightly came to the conclusion that learned advocate of the<br \/>\n\tplaintiffs has to argue out Ex.7 i.e. summons for judgment first.\n<\/p>\n<p>This<br \/>\n\tCourt has gone through the impugned order as also the relevant<br \/>\n\tprovisions of Order 37. It is crystal clear from the provisions of<br \/>\n\tOrder 37 that if the defendant enters an appearance, the summons for<br \/>\n\tjudgment shall be served. The defendant, upon the service of summons<br \/>\n\tfor judgment, is required in law to file an application for grant of<br \/>\n\tleave to defend the suit within ten  days of service of summons<br \/>\n\tdisclosing the facts entitling to defend the suit supported by an<br \/>\n\taffidavit. Such a prayer when made has to be disposed of by the<br \/>\n\tCourt in accordance with the provisions of law. The Court may or may<br \/>\n\tnot grant the leave to defend. The Court may also grant the leave to<br \/>\n\tdefend conditionally or unconditionally. However, such an<br \/>\n\tapplication has to be decided<br \/>\n\tfirst. Reliance is placed on the case of Mrs.Parvinder Kaur V.<br \/>\n\tRam Lal, AIR 1991 J &amp; K 5<br \/>\n\twherein it has eben observed as under:\n<\/p>\n<p> Order<br \/>\n\t3 of CPC deals with summary procedure for suits covered by it with<br \/>\n\tthe object to abridge the proceedings providing rapidity of<br \/>\n\tdisposal. The provisions of the Order are merely procedural and<br \/>\n\tcannot be construed as negativating or superseding the substantive<br \/>\n\trights of the debtor available to them under the ordinary law. When<br \/>\n\tthe defendant enters an appearance and is served a summons for<br \/>\n\tjudgment in the form prescribed, he has a right to pray by affidavit<br \/>\n\tor otherwise permission leave to defend the suit after disclosing<br \/>\n\tsuch facts as are deemed sufficient to entitle him. Such a prayer<br \/>\n\twhen made has to be disposed of by the Court in accordance with the<br \/>\n\tprovisions of law.\n<\/p>\n<p>The<br \/>\n\trevision is accordingly allowed. Impugned order dated 12-9-2000<br \/>\n\tpassed below Ex.1 in Special Summary Suit No.942 of 1996 is hereby<br \/>\n\tquashed and set aside. Learned Civil Judge is directed to  decide<br \/>\n\tthe application for leave to defend the suit submitted by the<br \/>\n\tdefendant first and then to proceed with the suit.
