I  \n\nTHIS APPEAL COMING ON FOR HEARING   \n\nCOURT DELIVERED THE FOLLOWING: _- \"\n\nJUDGMENT\n<\/pre>\n
The Insurance Company has call’ediin_ques’ti.oni the fudgment
\nand award dated 12.04.2006 p’a~ssec_lxin_:l\\liV_C1:Noi1553\/20004. The
\nquantum of compensation as   Tribunal is<\/p>\n
questioned.\n<\/p>\n
2. On hearing the lea1rn:e’cl.i-‘Counsel for the parties, the only
\naspect  arises for’c\u00abon_si.deration with regard to the quantum<\/p>\n
is fegardiiig thve’.llo’sst” earning capacity which has been awarded<\/p>\n
 I .  by the  ..  I I I<\/p>\n
~    The”learned Counsel for the appellant would contend that<\/p>\n
  was not justified in reckoning the disability at 30% to<\/p>\n
. T\ufb02iepiiewhole body-, when the Tribunal has accepted the disability of<\/p>\n
I<\/p>\n
‘I’<\/p>\n
34% stated by the doctor with reference to the right upperillit<\/p>\n
is therefore contended that the normal ratio of 1\/”Ij3_.”d  if<\/p>\n
accepted for the whole body and the compensation  tokbeg<\/p>\n
reduced.\n<\/p>\n
4. The learned Counsel for thellrespondent,_however\u00a7, sought<\/p>\n
to justify the award passed bythe  contended that<\/p>\n
the Tribunal on noticing the avocatiorifof has thought’<\/p>\n
it appropriate to awardi_’– the  reckoning the
\ndisability at 30%   does not call for<\/p>\n
interference.\n<\/p>\n
5. in thelightrof ‘whatl’l1as*–.been contended, the fact relating
\nto the nature of the-\u00bb injuries suffered as indicated in Ex.P.4 –
\n r:ertif.”1cEate is__not inwclispute. The nature of injuries also<\/p>\n
indica’tes.u.pper limb 1 \/3rd radius of right forearm. In<\/p>\n
7,}-a’ot the said  is the cause for the doctor to state the<\/p>\n
 Inv.f_this regard, the doctor has issued the disability<\/p>\n
 4’eerti\ufb01cate,j_vyj1ich is marked as Ex.P16. The said document would<\/p>\n
. ilrid–ilcate”5that the doctor has assessed the disability at 34%.<\/p>\n
J\u00bb<\/p>\n
‘9<\/p>\n
Though the doctor has indicated the said disability, _a_s_l’_<\/p>\n
procedure ALIMACO, the doctor has not thereafter  <\/p>\n
disabiiity to the whole body. The Tribunaihas and-_,e eefeiieeueeeeievl<\/p>\n
further to indicate the basis for reckoning thei’d’isabili’tyyi.at.i30%;’xiii’e.<\/p>\n
a normal circumstance, when the diisvability  stated?to’–the'”1imb, it<\/p>\n
the conventional method is to adopt—~il;A.]iv3*5’~~..of  as the
\ndisability to the whole body  case, even though
\nreckoning of 30% cannot  \u00abico’nitention of the
\nlearned Counsel  be taken as 1\/3rd
\nalso cannot be  claimant is a lady
\nand even   yfraiciture, 3 Considering that there is
\ndisability to the.._riglhti  and she is engaged in milk
\nvending business,   bel’a1;ipropriate to reckon the disability
\n  \u00abhas been stated by the doctor in the<\/p>\n
facts and circun1s’tancevsi.~of the present case.<\/p>\n
v.6. ?{fi”the’–iy4V disability is reckoned to 17% and if the<\/p>\n
c_omp’ensat3.on under the head of ‘loss of future earning’ is<\/p>\n
 “the claimant would be entitled to a sum of Rs.91,800\/–.<\/p>\n
    the Tribunal has awarded a sum of Rs.1,62,000\/- under the<\/p>\n
l<\/p>\n
said head, the same calls for reduction and as such,  3<\/p>\n
under the said head is reduced by a sum of Rs.70,2″C5.jO\/  <\/p>\n
other respects, the compensation awarded’*by “the_:.’I5rib_ur1aIV\u00ab’<\/p>\n
retained.\n<\/p>\n
In terms of the above, the appu\u00e9a1_xhstands’ ‘disposed; of. No
\norder as to costs. The amount i:ri”V-\u00ab:1ep4.5sit_ shali beremitted to<\/p>\n
