12.   24.10.2011.            The petitioners have approached this Court,<\/p>\n
                     under Section 482 of the Code of Criminal Procedure,<\/p>\n
                     for quashing the order dated 12.11.2007 passed by the<\/p>\n
                     court of Sri V. Kumar, Judicial Magistrate, First Class,<\/p>\n
                     Ara, in Ara (Town) P.S. Case No.295 of 2005, taking<\/p>\n
                     cognizance of the offence under Sections 341 and 323\/34<\/p>\n
                     of the Indian Penal Code and Sections 25(1-B)A, 26\/35<\/p>\n
                     of the Arms Act against the accused-petitioners.
\n              2<\/span><\/p>\n
         2. In brief, the fact, leading to this application<\/p>\n
is that on the basis of the written report of the informant-<\/p>\n
opposite party no.2, Munilal Sah, who is reported to be<\/p>\n
dead, Ara (Town) P.S. Case No.295 of 2005 was<\/p>\n
instituted on 12.12.2005 under Sections 341, 323 and<\/p>\n
379 of the Indian Penal Code against the accused-<\/p>\n
petitioners alleging that on 12.12.2005 he had gone to<\/p>\n
Phinopolice Ramna Road in connection with the work of<\/p>\n
share of Syndicate Bank, where his Munshi met him and<\/p>\n
informed that his Samadhi, petitioner no.1, Pandit<\/p>\n
Awadhesh Kumar, with whom litigation was going on,<\/p>\n
arising out of Bikramganj Police Station Case No.19 of<\/p>\n
2004, has asked to talk of compromise for the aforesaid<\/p>\n
case. Thereafter, he alongwith his Munshi went to the<\/p>\n
house of the accused-petitioner no.1, then the accused-<\/p>\n
petitioner no.1 started abusing and assaulted him through<\/p>\n
fists and with intention to kill surrounded him and<\/p>\n
locked him in a room.        Thereafter, all the accused-<\/p>\n
petitioners brutally assaulted him and snatched cash<\/p>\n
Rs.25,000\/- , golden chain, wrist watch, share papers etc.<\/p>\n
from him. At that time, accused-petitioner no.1 kept old<\/p>\n
country made pistol in his waist and cartridges in his
\n               3<\/span><\/p>\n
hand and with the help of villagers, handed over to the<\/p>\n
police.\n<\/p>\n
          3. After investigation, the police submitted the<\/p>\n
chargesheet       against   the   accused-petitioners   under<\/p>\n
Sections 341 and 323\/34 of the Indian Penal Code and<\/p>\n
Sections 25(1-B)A, 26\/35 of the Arms Act in the court of<\/p>\n
the Chief Judicial Magistrate, Ara, and, thereafter, the<\/p>\n
learned Judicial Magistrate took the cognizance of the<\/p>\n
offence under the aforesaid Sections on perusal of the<\/p>\n
chargesheet and the case diary against the accused-<\/p>\n
petitioners   through       the   impugned      order   dated<\/p>\n
12.11.2007.\n<\/p>\n
          4. Learned counsel for the petitioners submits<\/p>\n
that the informant-opposite party no.2, Munilal Sah, who<\/p>\n
was the Samdhi of the accused-petitioner no.1, Pandit<\/p>\n
Awadhesh      Kumar,        was   the   named    accused   in<\/p>\n
Bikramganj P.S. Case No.19 of 2004, lodged for the<\/p>\n
offence under Section 304-B and other allied Sections of<\/p>\n
the Indian Penal Code and Sections 3\/4 of the Dowry<\/p>\n
Prohibition Act, for causing the death of the daughter of<\/p>\n
accused-petitioner no.1, due to non fulfillment of dowry<\/p>\n
demand. The said case is pending in the court of Fast
\n              4<\/span><\/p>\n
Track Court-II, Sasaram, for framing of the charge. The<\/p>\n
informant-opposite party no.2 and his family members,<\/p>\n
named accused of that case, were pressurizing the<\/p>\n
accused-petitioners to compromise the case as the son of<\/p>\n
the informant-opposite party no.2 is still in jail. It has<\/p>\n
also been submitted that from the side of the informant-<\/p>\n
opposite party no.2, a case bearing Bikramganj P.S. Case<\/p>\n
No.69 of 2004 was lodged against the accused-<\/p>\n
petitioners in which final forms were submitted. On the<\/p>\n
alleged date of occurrence, the informant-opposite party<\/p>\n
no.2 alongwith 6-7 miscreants, all of sudden, rushed at<\/p>\n
the house of the accused-petitioners and tried to terrorize<\/p>\n
the accused-petitioners to compromise the dowry death<\/p>\n
case on the point of pistol but with the help of villagers,<\/p>\n
the informant-opposite party no.2 was handed over to the<\/p>\n
police with firearm regarding which Ara (Town) P.S.<\/p>\n
Case No.294 of 2005 was instituted by the police, which<\/p>\n
would appear from Annexure-‘5’ to this application and<\/p>\n
only with a view to take revenge to the accused-<\/p>\n
petitioners, in collusion with the police, the present case<\/p>\n
has been filed by the informant-opposite party no.2<\/p>\n
against the accused-petitioners.\n<\/p>\n
              5<\/span><\/p>\n
        5. From perusal of the F.I.R., it appears that the<\/p>\n
allegation of the informant-opposite party no.2 is that on<\/p>\n
the alleged date of occurrence, on sending information,<\/p>\n
he was called by the accused-petitioner no.1 for talking<\/p>\n
about the compromise of the case related to Bikramganj<\/p>\n
P.S. Case No.19 of 2004 and on reaching there, the<\/p>\n
informant-opposite party no.2 was brutally assaulted by<\/p>\n
the accused-petitioners and the accused-petitioner no.1,<\/p>\n
forcibly kept the old country made pistol in his waist and<\/p>\n
cartridges in his hand and handed over him to police.<\/p>\n
        6. The impugned order goes to show that the<\/p>\n
learned Magistrate on perusal of the chargesheet arrived<\/p>\n
at the conclusion that prima facie the case for offence<\/p>\n
under Sections 341 and 323\/34 of the Indian Penal Code<\/p>\n
and Sections 25(1-B)A, 26\/35 of the Arms Act is made<\/p>\n
out against the accused-petitioners and, accordingly,<\/p>\n
took the cognizance of the offence under the aforesaid<\/p>\n
Sections through the impugned order dated 12.11.2007.<\/p>\n
         At the     time   of taking cognizance,        the<\/p>\n
Magistrate\/court is only required to see whether on<\/p>\n
perusal of the F.I.R. and the case diary, prima facie, case<\/p>\n
is made out or not. At that time, the Magistrate\/court
\n                      6<\/span><\/p>\n
       could look into the defence.\n<\/p>\n
                7.       Under the aforesaid facts and the<\/p>\n
       circumstances of the case, I do not find that the<\/p>\n
       impugned      order suffers    from any illegality for<\/p>\n
       interference with the same in inherent jurisdiction under<\/p>\n
       Section 482 of the Code of Criminal Procedure.<\/p>\n
                8.    Accordingly,    this   application   stands<\/p>\n
       dismissed. However, it is made clear that the petitioners<\/p>\n
       would be at liberty to raise all the points, raised herein,<\/p>\n
       at the appropriate stage in the court below.<\/p>\n
