The same<br \/>\nis worth appreciating.  In fact, order dated 28.06.2004 ought to have<br \/>\nbeen challenged as soon as it was passed, but for the reasons known<br \/>\nto the petitioners, the same was not done.  Not only that, it was not<br \/>\nchallenged soon, as per the legal advise available to the<br \/>\npetitioners, the petitioners chose to file a restoration application<br \/>\non 08.08.2006.\n<\/p>\n<p>\tBy any standards, this restoration application itself was beyond<br \/>\ntime and therefore, an application seeking condonation of delay was<br \/>\nfiled along with the restoration application.\n<\/p>\n<p>4.\tThe Tribunal condoned the delay caused in filing the restoration<br \/>\napplication.  But, merely because delay was condoned, the restoration<br \/>\napplication did not become maintainable or liable to be granted.  The<br \/>\nTribunal thereafter considered the restoration application on merits<br \/>\nand found that the restoration application is not having sufficient<br \/>\nmerit to be granted and therefore, dismissed the same by order dated<br \/>\n17.05.2008.\n<\/p>\n<p>\tIn an appeal which was not alive in view of the order passed on<br \/>\ndelay condonation application on 28.06.2004, there was no question of<br \/>\nfiling any restoration application, but nobody can prevent the<br \/>\npetitioners from filing such restoration application, even if it was<br \/>\nafter lapse of more than two years.  Only because the Tribunal had<br \/>\ncondoned the delay, the petitioners do not get right to say that his<br \/>\nrestoration application be also allowed, whereby a matter which has<br \/>\nalready died on account of non-condonation of delay in the year 2004,<br \/>\nbe brought to life.\n<\/p>\n<p>5.\tIn view of the aforesaid facts, wherein the had appeal already<br \/>\ndied as the delay condonation was refused in the year 2004, cannot be<br \/>\nallowed to come to life by interfering with the order passed on<br \/>\nrestoration application, which otherwise does mot warrant any<br \/>\ninterference at the hands of this Court.\n<\/p>\n<p>6.\tEven on merits if the petitioners have the case that the decree as<br \/>\nis passed against the petitioners could not have been passed in that<br \/>\nformate, the petitioners have lost that opportunity by not<br \/>\nchallenging order dated 28.06.2004 for all these years.  The so<br \/>\ncalled challenge to that order, in the form of restoration<br \/>\napplication, was also after expiry of more than two years.
