PARTIES.\n                                -----------\n<\/pre>\n<p>3   03.11.2011              Heard   learned     counsel    for    the<\/p>\n<p>                 petitioner, learned counsel for the State and<\/p>\n<p>                 learned counsel for the Accountant General.<\/p>\n<p>                            Learned counsel for the petitioner<\/p>\n<p>                 accepts that, by treating the petitioner to<\/p>\n<p>                 have   superannuated         with   effect      from<\/p>\n<p>                 31.01.2010, petitioner&#8217;s entire post-retiral<\/p>\n<p>                 benefits    have   been   calculated     and    paid,<\/p>\n<p>                 except some petty amount. However, he submits<\/p>\n<p>                 that now the opposite parties are disputing<\/p>\n<p>                 his date of superannuation and are taking a<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>          stand      that         his            effective    date        of<\/p>\n<p>          superannuation is 31.01.2008. In view of the<\/p>\n<p>          said dispute, petitioner now apprehends that<\/p>\n<p>          some    orders    may        be    passed     adverse     to   the<\/p>\n<p>          petitioner which may cause pecuniary loss to<\/p>\n<p>          him.\n<\/p>\n<p>                      The    date       of       superannuation     of   the<\/p>\n<p>          petitioner was not an issue before this Court<\/p>\n<p>          in the writ matter and the correctness of the<\/p>\n<p>          same was not considered while disposing of<\/p>\n<p>          the same. Hence, this Court cannot pass any<\/p>\n<p>          order in this contempt proceeding in respect<\/p>\n<p>          of correctness of the date of superannuation<\/p>\n<p>          of the petitioner.\n<\/p>\n<p>                      If         the         petitioner       has        any<\/p>\n<p>          apprehension with regard to that stand of the<\/p>\n<p>          opposite     parties,             he     is   at   liberty      to<\/p>\n<p>          challenge        the     same           in    an   appropriate<\/p>\n<p>          proceeding in accordance with law.<\/p>\n<p>                      The MJC application is disposed of.<\/p>\n<pre>Arvind\/                           ( J.N.
