Dattu, C. J:\n<\/p>\n<p>      Appellant in W.A.No.182\/2008 is the complainant in this Contempt<\/p>\n<p>Petition.\n<\/p>\n<p>      2. In the Contempt Petition filed, the complainant alleges that the<\/p>\n<p>respondents have disobeyed the directions issued by this Court at paragraph<\/p>\n<p>9 of the order and therefore requests us to initiate appropriate contempt<\/p>\n<p>proceedings against the respondents for their wilful and deliberate<\/p>\n<p>disobedience of the orders and directions issued by this Court.<\/p>\n<p>      3. This Court while disposing of the WA.182\/2008 by its order dated<\/p>\n<p>5th February 2008, at paragraph 9 had stated as under:<\/p>\n<blockquote><p>             &#8220;Taking into consideration all these aspects<\/p>\n<p>             of the matter, in our opinion, for the present,<\/p>\n<p>             we need not grant the reliefs sought by the<\/p>\n<p>             appellant\/petitioner.           However, we make it<\/p>\n<p>             clear that the respondent shall complete the<\/p>\n<p>             investigation and enquiry and pass final<\/p>\n<p>             orders as expeditiously as possible, at any<\/p>\n<p>             rate within three months from today, if the<\/p>\n<p>             petitioner co-operates with the Department.<\/p>\n<p>             The appellant\/petitioner is permitted to have<\/p>\n<p>             the assistance of the learned counsel when he<\/p>\n<p>             participates in the enquiry proceedings that<\/p>\n<p><span class=\"hidden_text\">CCC.1359\/2008.                     2<\/span><\/p>\n<p>              may be held by the respondent as directed by<\/p>\n<p>              us&#8221;<\/p><\/blockquote>\n<p>      4. A perusal of the directions issued by this Court would clearly<\/p>\n<p>indicate that the respondent shall complete the investigation and the enquiry<\/p>\n<p>and pass final orders within an outer limit of three months from the date of<\/p>\n<p>the order, provided the appellant co-operates with the Department.<\/p>\n<p>      5. The second respondent has filed a detailed counter affidavit. In<\/p>\n<p>paragraph 2 of the affidavit it is stated that though several summons\/<\/p>\n<p>notices were issued to the appellant to participate in the investigation and<\/p>\n<p>also in the enquiry, the appellant did not choose to appear before him and<\/p>\n<p>therefore there is neither wilful nor delilberate disobedience of the orders<\/p>\n<p>and directions issued by this Court.\n<\/p>\n<p>      6. We have carefully perused the orders passed by us while disposing<\/p>\n<p>of WA.No.182\/2008 and also the counter affidavit filed by the respondent.<\/p>\n<p>In our opinion, the respondents have done whatever that is possible in their<\/p>\n<p>hands to get the co-operation of the appellant and to comply with the orders<\/p>\n<p>and directions issued by this Court. Since the appellant had not co-operated<\/p>\n<p>with the respondents, they have not completed the investigation and enquiry<\/p>\n<p>and also not passed final orders as directed by this Court. If anybody has to<\/p>\n<p><span class=\"hidden_text\">CCC.1359\/2008.                     3<\/span><\/p>\n<p>be blamed, it is only the appellant and he cannot blame the respondents for<\/p>\n<p>not complying with the orders and directions issued by this Court. In that<\/p>\n<p>view of the matter, we decline to take cognizance of this Contempt Petition.<\/p>\n<p>      7. Accordingly the Contempt Petition is closed.<\/p>\n<p>      Ordered accordingly.\n<\/p>\n<\/p>\n<p>                                                    H.L.
