It is<br \/>\nsubmitted that they will abide by any conditions that may be imposed<br \/>\nby this Court. It is further submitted that the offences alleged<br \/>\nagainst the lady accused are triable by the learned JMFC and<br \/>\ntherefore, it is submitted that the application may be allowed.\n<\/p>\n<p>5.\tPer<br \/>\ncontra, Mr KL Pandya, learned APP representing the State opposed this<br \/>\napplication and stated that considering the FIR and the role played<br \/>\nby both these 3 accused in the incident, the application may be<br \/>\nrejected.\n<\/p>\n<p>6.\tHaving<br \/>\nconsidered the submissions advanced on behalf of both the sides and<br \/>\nconsidering the FIR and the role attributed to both the petitioners<br \/>\nin the FIR so also the fact that the offences alleged against the<br \/>\npetitioners are triable by the learned JMFC, this Court is of the<br \/>\nopinion that the regular bail application preferred by the lady<br \/>\npetitioners under Section 439 of the Code of Criminal Procedure, 1973<br \/>\ndeserves to be granted.\n<\/p>\n<p>7.\tConsidering<br \/>\nthe submissions made on behalf of the parties and having regard to<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the petitioners are ordered to be released on bail in connection<br \/>\nwith Prohibition CR No.5165 of 2009 registered at Lodhika Police<br \/>\nStation, Rajkot (Rural) for the offence alleged against them in this<br \/>\napplication on their executing bond of Rs.5,000\/- each (Rupees five<br \/>\nthousand only) with one solvent surety of the like amount to the<br \/>\nsatisfaction of the lower Court and subject to the conditions that<br \/>\nthey shall,<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty.\n<\/p>\n<p>(b)\tnot<br \/>\ntry to tamper or pressurize the prosecution witnesses or complainant<br \/>\nin any manner.\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order and should co-operate the investigating officers;\n<\/p>\n<p>(d)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(e)\tnot<br \/>\nleave the local limits of State of Gujarat without the prior<br \/>\npermission of the concerned Trial Court;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of their residence to the Investigating Officer and also<br \/>\nto the Court at the time of execution of the bond and shall not<br \/>\nchange the residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\ntheir passports, if any, to the lower Court, within a week.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nTrial Court will be free to issue warrant or take appropriate action<br \/>\nin the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the Trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.
