POWER OF ATTORNEY HOLDER &amp; 2 -\nRespondent(s)\n \n\n=========================================================\n \nAppearance : \nMR\nMAULIK J SHELAT for\nPetitioner(s) : 1, \nNOTICE SERVED for Respondent(s) : 1 -\n3. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Petitioner-Insurance<br \/>\n\tCompany has challenged an order dated 21.11.2009 passed by MACT<br \/>\n\t(Main) Anand below application Exh.37 in MACP No.5875\/2006 (Old<br \/>\n\tNo.MACP No.2215 of 2003).\n<\/p>\n<p>Short<br \/>\n\tfacts are as follows:\n<\/p>\n<p>The<br \/>\n\trespondents had filed above mentioned claim petition for<br \/>\n\tcompensation for death of Dilipbhai Patel in a vehicular accident.<br \/>\n\tIn the claim petition, the claimants also filed an application under<br \/>\n\tSection 140 of M.V. Act seeking interim compensation. The claims<br \/>\n\tTribunal by its order dated 14th September, 2004 directed<br \/>\n\tthe opponents including the present petitioner &#8211; Insurance<br \/>\n\tCompany to deposit before the Tribunal Rs.50,000\/- with 9% interest<br \/>\n\tp.a. from the date of application till payment. It is not in dispute<br \/>\n\tthat pursuant to the said order dated 14th September,<br \/>\n\t2004, the petitioner-Insurance Company deposited Rs.67,362\/- through<br \/>\n\tcheque dated 16.10.2007 drawn on HDFC Bank Ltd.\n<\/p>\n<p>Eventually,<br \/>\n\tthe claim petition was decided by the Tribunal. Claimants were<br \/>\n\tgranted compensation of Rs.3,13,000\/- with interest of 7.5% per<br \/>\n\tannum from the date of filing of the claim petition till realization<br \/>\n\twith proportionate cost. In the said order, the Tribunal clearly<br \/>\n\tspecified that &#8220;Interim amount, if any, paid to the claimant<br \/>\n\tbe adjusted at the time of final disbursement&#8221;.\n<\/p>\n<p>Since<br \/>\n\tthe award was not satisfied, the claimants filed execution<br \/>\n\tproceedings before the Claims Tribunal. In response to the execution<br \/>\n\tnotice, the petitioner-Insurance Company deposited sum of<br \/>\n\tRs.4,24,238\/- under protest on or around 25.1.2008. It is not in<br \/>\n\tdispute that while claiming the total amount of Rs.4,24,238\/-, the<br \/>\n\tclaimants had not adjusted the interim compensation received from<br \/>\n\tthe Insurance Company under order dated 14th September,<br \/>\n\t2004 passed by the claims Tribunal. Without adjustment of the said<br \/>\n\tamount, the Tribunal also disbursed the entire amount of<br \/>\n\tRs.4,24,238\/- deposited by the Insurance Company.\n<\/p>\n<p>\tAt one stage,<br \/>\n\tInsurance Company was considering challenging the award itself,<br \/>\n\thowever, under legal advise directed not to challenge the award.<br \/>\n\tEventually, the Insurance Company realizing the error that the<br \/>\n\tclaimants had received certain amount twice filed application Exh.37<br \/>\n\ton 2.3.2009 before the Claims Tribunal and prayed that the amount of<br \/>\n\tinterim compensation paid by the Insurance Company be returned after<br \/>\n\trecovery from the claimants. It was on this application that the<br \/>\n\tClaims Tribunal passed its impugned order dated 21.11.2009.<br \/>\n\tApplication came to be dismissed primarily on the ground that facts<br \/>\n\twere not brought to the notice of the Tribunal by the Insurance<br \/>\n\tCompany at the relevant time and the present application is filed<br \/>\n\tlong after the disbursement order was also passed. Mainly on these<br \/>\n\tgrounds, the application of the petitioner-Insurance Company came to<br \/>\n\tbe dismissed.\n<\/p>\n<p>I<br \/>\n\thave heard learned advocate Mr.Shelat for the petitioner and<br \/>\n\tMr.Mehul Vakharia for the respondents.\n<\/p>\n<p>From<br \/>\n\tthe above factual aspects, it would emerge that undisputably the<br \/>\n\tclaimants had received Rs.50,000\/- with cost by way of interim<br \/>\n\tcompensation during the pendency of the main claim petition. While<br \/>\n\tdisposing the claim petition finally, the award of Rs.3,13,000\/- by<br \/>\n\tway of compensation with specified interest and cost, the Tribunal<br \/>\n\tprovided that interim compensation, if already received, will be<br \/>\n\tadjusted. When the execution application was filed by the claimants,<br \/>\n\tthe amount of interim compensation paid over was not adjusted. The<br \/>\n\tTribunal therefore affected recovery of the entire claim and<br \/>\n\tInsurance Company also unfortunately, though deposited the amount<br \/>\n\tunder protest, did not bring full facts to the notice of the<br \/>\n\tTribunal. It is true that there was delay on part of the Insurance<br \/>\n\tCompany. However, delay itself in the facts of the present case<br \/>\n\twould not defeat the right of the Insurance Company. It was<br \/>\n\tprimarily duty of the claimants also to bring true and full facts to<br \/>\n\tthe notice of the Tribunal. The claimants cannot take an advantage<br \/>\n\tof their own wrong and plead delay.\n<\/p>\n<p>By<br \/>\n\tno means, the claimants can receive any amount twice. They must<br \/>\n\tsuffer adjustment by the interim compensation previously paid. Under<br \/>\n\tthe circumstances, the request of the petitioner is required to be<br \/>\n\tgranted. However, in view of the delay on the part of the Insurance<br \/>\n\tCompany instead of undertaking fresh calculation and also<br \/>\n\tcalculating interest on the amount already paid by way of interim<br \/>\n\tcompensation, by way of rough and ready formula, it is provided that<br \/>\n\tout of compensation already received by the claimants, Insurance<br \/>\n\tCompany will be entitled to get back sum of Rs.67,362\/- paid by way<br \/>\n\tof interim compensation. Such amount be recovered form the<br \/>\n\tinvestments made out of the compensation received by the claimants<br \/>\n\ttaking care to ensure that claimants be put to minimum loss of<br \/>\n\tinterest. This order shall be implemented within 8 (eight) weeks<br \/>\n\tfrom today by the Claims Tribunal.
