Justice A.K.BASHEER\n\n Dated :14\/11\/2008\n\n O R D E R\n                    H.L.DATTU, C.J. &amp; A.K.BASHEER, J.\n                   ------------------------------------------------------\n                             S.T.Rev.No. 314 of 2006 &amp;\n                            C.M.Appln.No.708 of 2006\n                       ---------------------------------------------\n                   Dated, this the 14th day of November, 2008\n\n                                       O R D E R\n<\/pre>\n<p>H.L.Dattu, C.J.\n<\/p>\n<p>               State, being aggrieved by the orders passed by the Kerala Sales<\/p>\n<p>Tax Appellate Tribunal, Additional Bench, Kozhikode in T.A.No.413\/2002<\/p>\n<p>dated 16.5.2003, is before us in this revision petition.<\/p>\n<p>               (2) In filing the revision petition there is a delay of 960 days. To<\/p>\n<p>condone the said delay, C.M.Appln.No.708\/2006 is filed under Section 5 of<\/p>\n<p>the Limitation Act. Along with the said application an affidavit is filed before<\/p>\n<p>us. In the said affidavit except stating that the papers were moving from table<\/p>\n<p>to table and person to person, no other explanation is offered by the Revenue<\/p>\n<p>for the delay in filing the revision petition.<\/p>\n<p>               (3) The explanation offered by the petitioner for condonation of<\/p>\n<p>the delay in filing the Sales Tax Revision case is wholly unsatisfactory.<\/p>\n<p>Therefore, the delay in filing the revision petition cannot be condoned by us.<\/p>\n<p>Accordingly the application for condonation of delay requires to be rejected<\/p>\n<p>and it is rejected.\n<\/p>\n<p>               (4) Consequently the revision petition is also rejected.<\/p>\n<p><span class=\"hidden_text\">S.T.Rev.No.314\/2006                  -2-<\/span><\/p>\n<p>              (5).
