Application stands disposed of.\n<\/p>\n<p>CWP No. 11506 of 2008:\n<\/p>\n<p>            This petition filed in public interest prays for a direction against<\/p>\n<p>the respondents to take steps to prevent occurrence of mishaps at work sites<\/p>\n<p>where pits are dug and also to cover manholes, wherever drains<\/p>\n<p>run through public places.\n<\/p>\n<p><span class=\"hidden_text\"> CIVIL WRIT PETITION NO. 11506 OF 2008                                  -2-<\/span><\/p>\n<p>            When this petition came up for hearing before this Court on<\/p>\n<p>August 4, 2008, respondent No. 2 was directed to place on record the<\/p>\n<p>policy, if any, finalised by the Haryana Urban Development Authority for<\/p>\n<p>protection of humans living in the vicinity of drainages and manholes and<\/p>\n<p>around places where excavation has been or is proposed to be carried out<\/p>\n<p>by the respondents. The respondent has pursuant to the said order filed a<\/p>\n<p>counter affidavit and placed on record a circular dated August 14, 2008,<\/p>\n<p>issued to all the Superintending Engineers, HUDA, by the Chief Engineer,<\/p>\n<p>HUDA, setting out the guidelines that require the contractors to take proper<\/p>\n<p>precautions while laying underground sewerage\/draining lines in places<\/p>\n<p>where HUDA has allotted civil works. From a reading of the said<\/p>\n<p>guidelines, we are of the view that HUDA is sensed to the need for<\/p>\n<p>preventing accidents on account of carelessness of the contractors,<\/p>\n<p>employed by it and that the necessary instructions have been issued to the<\/p>\n<p>engineering staff to ensure that the guidelines formulated by HUDA are<\/p>\n<p>strictly adhered to by the contractors. In the circumstances, therefore, and in<\/p>\n<p>the light of the said guidelines, we see no room for issuing any further<\/p>\n<p>directions from this Court except that in the event of any mishap taking<\/p>\n<p>place on account of any act of negligence on the part of HUDA or its<\/p>\n<p>contractors, the aggrieved party shall be entitled to seek redress in<\/p>\n<p>appropriate proceedings before the competent Court.
