Justice K.SURENDRA MOHAN\n\n Dated :20\/12\/2010\n\n O R D E R\n<\/pre>\n<p>           R.BASANT &amp; K.SURENDRA MOHAN, JJ.\n<\/p>\n<p>                      ***********************<br \/>\n                  Mat.Appeal No.1013 of 2010<br \/>\n                   *****************************<br \/>\n            Dated this the 20th day of December, 2010<\/p>\n<p>                       ORDER\/JUDGMENT<\/p>\n<p>BASANT, J.\n<\/p>\n<p>      The appellant has come before this Court to challenge the<\/p>\n<p>impugned decree which obliges him to return money and<\/p>\n<p>ornaments to the respondent\/his wife.<\/p>\n<p>      2.   The impugned order is an exparte order. The appeal<\/p>\n<p>is filed along with a petition to condone the long delay of 552<\/p>\n<p>days in fling the appeal.\n<\/p>\n<p>      3.   The matter was discussed at the Bar. The learned<\/p>\n<p>counsel for the appellant was called upon to explain how the<\/p>\n<p>challenge on merits can be sustained. The learned counsel for<\/p>\n<p>the petitioner\/appellant was also requested to explain why no<\/p>\n<p>petition has been filed to get the exparte order set aside.<\/p>\n<p>      4.   After discussions at the Bar, the learned counsel for<\/p>\n<p>the petitioner\/appellant only submits that these application for<\/p>\n<p>condonation of delay and the Mat.Appeal may now be dismissed<\/p>\n<p>as withdrawn making it clear that such dismissal as withdrawn<\/p>\n<p>will not in any way fetter the rights of the petitioner\/appellant to<\/p>\n<p><span class=\"hidden_text\">Mat.Appeal No.1013 of 2010       2<\/span><\/p>\n<p>move the Family Court to get the exparte order set aside in<\/p>\n<p>accordance with law.\n<\/p>\n<p>      5.    We accept the request of the learned counsel for the<\/p>\n<p>petitioner\/appellant. The petition for condonation of delay and<\/p>\n<p>the Matrimonial Appeal are hence dismissed as withdrawn<\/p>\n<p>making it clear that the dismissal of the petition for condonation<\/p>\n<p>of delay and the rejection of the Matrimonial Appeal as<\/p>\n<p>withdrawn will not in any way affect the rights of the<\/p>\n<p>petitioner\/appellant to move the Family Court to get the exparte<\/p>\n<p>order passed against him set aside in accordance with law.<\/p>\n<p>      6.
