    This appeal is preferred against the award<\/p>\n
of  the   Motor    Accidents    Claims    Tribunal,<\/p>\n
Thodupuzha in O.P.(MV)340\/06.        The claimant<\/p>\n
sustained  injuries in a road accident and the<\/p>\n
Tribunal awarded a compensation of Rs.22,800\/-<\/p>\n
and directed it to reimburse from the insurance<\/p>\n
company.    It is against that decision the<\/p>\n
insurance company has come up in appeal.<\/p>\n
     2. Heard   the  learned    counsel   for  the<\/p>\n
appellant as well as the 3rd respondent, owner.<\/p>\n
The two points that emerge for consideration in<\/p>\n
the appeal are, one, regarding the question<\/p>\n
whether the absence of a badge would amount to a<\/p>\n
breach of policy condition and secondly, when<\/p>\n
there is a transfer of the vehicle, who is to be<\/p>\n

affixed with the liability.\n<\/p>\n
    3.    So far as the licence is concerned the<\/p>\n
vehicle involved in the accident is a passenger<\/p>\n
carrying auto rickshaw which comes under the<\/p>\n
definition of the word transport vehicle under<\/p>\n
the M.V.Act. S.3(1) of the M.V.Act very clearly<\/p>\n
states   that  a   person   should have a   duly<\/p>\n
authorised licence to drive a vehicle which he<\/p>\n
is plying.   There cannot be any dispute that in<\/p>\n
order to constitute a valid and proper driving<\/p>\n
licence to drive a public vehicle like an auto<\/p>\n
rickshaw it is necessary to have a licence and a<\/p>\n
badge.    Or in otherwords, the badge is a due<\/p>\n
authorisation permitting the person to drive a<\/p>\n
public vehicle.    Therefore the finding of the<\/p>\n
Tribunal that the absence of a badge does not<\/p>\n
militate against the driver cannot be upheld.<\/p>\n
The   Hon’ble  Supreme  Court   in the  decision<\/p>\n
M.A.C.A. 1975 OF 2010
\n                         -:3:-<\/span><\/p>\n
reported in New India Assurance Co. Ltd. v.<\/p>\n
Roshanben Rahemansha Fakir<\/a> (2008 (3) TAC 20<\/p>\n
(SC). 2008 (8) SCC 253 considered the question<\/p>\n
and held that when the driver of a vehicle is<\/p>\n
not possessing a valid driving licence to drive<\/p>\n
a transport vehicle there is breach of policy<\/p>\n
condition.     So  in  the    light of the  said<\/p>\n
pronouncement it has to be held that the insured<\/p>\n
is bound to reimburse the amount in favour of<\/p>\n
the insurer.    So the finding to the contra by<\/p>\n
the Tribunal is therefore set aside.<\/p>\n
    4.    The next contention is regarding the<\/p>\n
ownership of the vehicle.      Even the insurance<\/p>\n
company in their written statement has contended<\/p>\n
that    the   ownership  of    the  vehicle  was<\/p>\n
transferred to Sudhish S\/o Kochappu prior to the<\/p>\n
accident.    Under the provisions of the M.V.Act<\/p>\n
and especially u\/s 2(30) a person in possession<\/p>\n

\n                         -:4:-<\/span><\/p>\n
can also be an owner of the vehicle.     The sale<\/p>\n
being one under the provisions of the Sale of<\/p>\n
Goods Act parting with possession and receiving<\/p>\n
consideration amounts to divestiture of title.<\/p>\n
The Courts have very clearly held that the<\/p>\n
transfer of registration is a conduct subsequent<\/p>\n
to the sale and therefore the mere non-transfer<\/p>\n
cannot vitiate the same.     So it is also a point<\/p>\n
that has to be considered by impleading the<\/p>\n
person who is alleged to be the owner of the<\/p>\n
vehicle.\n<\/p>\n
    5.    Then    comes     the    question     of\n\nreimbursement.    It has to be stated that by\n\n<\/pre>\n
virtue of the decision of this Court reported in<\/p>\n
Ashraf v. Fathima<\/a> 2004 (2) KLT 598 since the<\/p>\n
contract of insurance is between the insurer and<\/p>\n
the insured the insurer can proceed only against<\/p>\n
the insured.    Therefore that is also a matter<\/p>\n

which requires consideration.    If such is the<\/p>\n
contingency and there is a finding to the effect<\/p>\n
that Sudhish is the owner of the vehicle then<\/p>\n
the insured cannot be left without any remedy<\/p>\n
and there can be a direction for reimbursement<\/p>\n
of the amount by Sudhish to the insured. So all<\/p>\n
these points requires consideration after the<\/p>\n
impleadment of Sudhish S\/o Kochappu.   Since the<\/p>\n
dispute is only with respect to reimbursement<\/p>\n
the claimant need not be dragged on. The learned<\/p>\n
counsel for the appellant also prays for an<\/p>\n
opportunity to adduce evidence with regard to<\/p>\n
the existence of a valid driving licence as on<\/p>\n
the date of the accident, that also can be<\/p>\n
permitted.\n<\/p>\n
    6.    Therefore the award under challenge so<\/p>\n
far as it relates to the liability part is set<\/p>\n
aside and the matter is remitted back to the<\/p>\n
M.A.C.A. 1975 OF 2010

Tribunal with a direction to consider all the<\/p>\n
points that has been discussed in the previous<\/p>\n
paragraphs of the judgment after impleading<\/p>\n
Sudhish S\/o Kochappu. The registered owner as<\/p>\n
well as this Sudhish be permitted to file<\/p>\n
written statement in support of their respective<\/p>\n
contentions and thereafter all be permitted to<\/p>\n
adduce both documentary as well as oral evidence<\/p>\n
in support of their respective contentions and<\/p>\n
then the matter be disposed of in accordance<\/p>\n
with law. Parties are directed to appear before<\/p>\n
the Tribunal on 25.2.2011.\n<\/p>\n<\/p>\n
