Vide this petition the petitioner has challenged the<\/p>\n<p>summons issued by ld. MM in CC No.3913 of 2011 under<\/p>\n<p>Section 138 of Negotiable Instruments Act.<\/p>\n<p>2.      Ld. counsel for the petitioner has challenged the very<\/p>\n<p>factum of complaint and summons dated 06.06.2011 on the<\/p>\n<p>ground of jurisdiction.      I have perused the complaint filed<\/p>\n<p><span class=\"hidden_text\">        CRL.M.C. 2885\/2011                         Page 1 of 4<\/span><br \/>\n against the petitioner.\n<\/p>\n<p>3.   Para 13 of the complaint is as under :<\/p>\n<blockquote><p>     &#8220;13. That the aforesaid legal notice of demand<\/p>\n<p>     stands duly served upon the accused persons as<\/p>\n<p>     on 09\/04\/2011 as per the A.D.Card received back.<\/p>\n<p>     But the accused persons have failed to make the<\/p>\n<p>     necessary payment in lieu of the necessary<\/p>\n<p>     cheques despite the lapse of the statutory period<\/p>\n<p>     of 15 days. Rather, they have sent a false and<\/p>\n<p>     frivolous reply dated 13.04.2011 to the above<\/p>\n<p>     notice denying their liability and making false<\/p>\n<p>     accusations against the complainant company.&#8221;<\/p>\n<\/blockquote>\n<p>4.   The cheque deposited by respondent at Delhi.         The<\/p>\n<p>legal notice has also been sent from Delhi.<\/p>\n<p>5.   On this issue I have already given my opinion in Crl<\/p>\n<p>Rev. P.170\/2010 in <a href=\"\/doc\/132673413\/\">GE Capital Transportation Financial<\/p>\n<p>Services Ltd vs. Rahisuddin Khan<\/a> decided on 09.09.2011.<\/p>\n<p>Keeping in view the \u201edoctrine of precedent\u201f, the judgment<\/p>\n<p>delivered by the Division Bench of the Apex Court in<\/p>\n<p>K.Bhashkaran Vs. Sankaran Vaidyan Balan &amp; Anr (1999) 7<\/p>\n<p>SCC 510 decided on 29.09.1999 is still binding till date. The<\/p>\n<p><span class=\"hidden_text\">     CRL.M.C. 2885\/2011                          Page 2 of 4<\/span><br \/>\n Supreme Court in case of K.Bhaskaran (supra) has held that<\/p>\n<p>the Court has the jurisdiction over a place from where legal<\/p>\n<p>notice is issued to the customer demanding payment of the<\/p>\n<p>dishonoured cheque under Section 138 of NI Act, apart from<\/p>\n<p>places where other components of offence has taken place<\/p>\n<p>under Section 138 NI Act :-\n<\/p>\n<pre>                 i)     drawing of the cheque;\n\n\n                 ii)    presentation of the cheques to the\n\n                 bank;\n\n\n<\/pre>\n<p>                 iii)   returning the cheque unpaid by the<\/p>\n<p>                 drawee bank;\n<\/p>\n<\/p>\n<p>                 iv)    giving notice in writing to the drawer<\/p>\n<p>                 of the cheque demanding payment of the<\/p>\n<p>                 cheques amount;\n<\/p>\n<\/p>\n<p>6.   In the present case two components are fulfilled<\/p>\n<p>(i) Cheque presented at Delhi<\/p>\n<p>(ii) Legal notice issued from Delhi.<\/p>\n<p>7.   In view of the judgment delivered on 09.09.2011 in the<\/p>\n<p>above stated case, I dismiss CRL.M.C. 2885\/2011.<\/p>\n<p>8.
