The<br \/>\nappellant has framed the<br \/>\nfollowing substantial questions of law for assailing the order and<br \/>\njudgment impugned in this second appeal.\n<\/p>\n<p>\t(I)\tWhether<br \/>\nin the facts and the circumstances \tof the case, the Ld. Lower<br \/>\nAppellate Court is \tjustified in the eye of law, in holding that the<br \/>\n\tplea of the ownership, and, the plea of Adverse \tPossession, cannot<br \/>\nexist and stand together even \tas the Alternative plea?\n<\/p>\n<p>\t(II)\tWhether<br \/>\nin the facts and the circumstances \tof the case, the Ld. Lower<br \/>\nAppellate Court is \tjustified in the eye of law, in holding that the<br \/>\n\tdecision of the Revenue   Authority has to be \tchallenged so as to<br \/>\nestablish the title of the \tplaintiff to the suit-land?\n<\/p>\n<p>\t(III)Whether<br \/>\nthe impugned judgment dated \t1.12.2009 which is based upon the<br \/>\nperverse  \tfinding of facts, in an Arbitrary manner, \tcontrary to the<br \/>\nLaw of Evidence, is sustainable \tin the eye of law?\n<\/p>\n<p>\t(IV)\tWhether<br \/>\nin the facts and the circumstances \tof the case, the Ld. Lower<br \/>\nAppellate Court is \tjustified in the eye of law, in holding that the<br \/>\n\tplea of the adverse<br \/>\npossession could be \tconsidered from the date of rejection of the<br \/>\n\tRevision Application by the Revenue Authority, \ti.e;17.1.1996,<br \/>\nrather than from the date of \tapplication to the then Administrator,<br \/>\ni.e. \t26.4.1936, which had been accepted, granted and \tacted upon by<br \/>\nboth the parties during the pre-\tindependence period?\n<\/p>\n<p>\t(V)Whether<br \/>\nin the facts and the circumstances of \tthe case, the Ld. Judge is<br \/>\njustified in the eye \tof law in deciding the issue as to the title to<br \/>\n\tthe suit-land on the basis of the decision \trendered by the<br \/>\nRevenue-Authorities in revenue-\tproceedings?\n<\/p>\n<p>2).\tFacts<br \/>\nin brief leading to the filing of this second appeal deserve to be<br \/>\nset out in order to appreciate the contention raised by the learned<br \/>\nadvocate for the appellant.\n<\/p>\n<p>3).\tThe<br \/>\nAppellant who is hereinafter referred to as a plaintiff had to file<br \/>\nRegular Civil Suit No.272 of 1997 for declaration and permanent<br \/>\ninjunction against the defendant in respect of suit land.  The<br \/>\nplaintiff made the<br \/>\nfollowing prayers in the suit.\n<\/p>\n<p>\t{1}<br \/>\nAs the plaintiff is enjoying the suit land \tsince last 60 years, the<br \/>\ndefendant may not evict \thim and restrain him from using the said<br \/>\nland \tand permitted the plaintiff to continue his \tpossession on the<br \/>\nsuit land without any \tobstruction and declaration that the defendant<br \/>\n\tdid not have any right to restrain the plaintiff \tfor enjoying the<br \/>\nsuit land.\n<\/p>\n<p>\t{2}If<br \/>\n in case, the plea of plaintiff with \tregard to adverse possession is<br \/>\nnot acceptable \tthen, on the strength of plaintiff&#8217;s enjoyment \tof<br \/>\nthe suit land for last more than 60 years, \tthe defendant be directed<br \/>\nto regularize his \tpossession on charging the requisite<br \/>\n\tfees\/penalty.\n<\/p>\n<p>\t{3}The<br \/>\npossession of the suit land may not be \ttaken without following due<br \/>\nprocedure of law.\n<\/p>\n<p>4).\n<\/p>\n<p>\tThe Trial Court relying upon the document at \texhi. 29 in the nature<br \/>\nof an application made by \tthe father of the plaintiff to the then<br \/>\n\tadministrator for seeking permission to put up \twindow etc. on the<br \/>\nwall of the property on the land, which was \tsaid to have been<br \/>\npurchased by him. In view of \tthis the due \tconclusion would be that<br \/>\nthe father \tof the \tplaintiff owned the land by way of \tpurchase and<br \/>\n\tsuch an \tapplication, which was \tmade in the year \t1936 was<br \/>\n\tsufficient evidence for declaring that the plaintiff and or his<br \/>\n\tfather were purchaser \tof \tthe suit land, and on \tthat basis, the<br \/>\nCourt decreed the suit in favour \tof the plaintiff by its \tjudgment<br \/>\n\tand order dated 5.3.2003.\n<\/p>\n<p>5).\tBeing<br \/>\naggrieved and dissatisfied with the said judgment and decree, the<br \/>\ndefendant i.e  State, preferred First Appeal No.4 of 2009 wherein the<br \/>\nAppellate Court came to the conclusion that the factum of Revenue<br \/>\nProceedings and the order of State through its Deputy Secretary not<br \/>\naccepting the claim of the plaintiff with regard to land in question<br \/>\ncould not have been brushed aside by the Trial Court and, therefore,<br \/>\nthe documents which are relied upon by the Trial Court namely Exhi.29<br \/>\ncould not have been said to be documents so capable of being<br \/>\nconstrued as title deed or conferring any title sustainable in law<br \/>\nwith regard to land in question.  The Appellate Court allowed the<br \/>\nappeal by quashing and setting aside the judgment and decree impugned<br \/>\ntherein.\n<\/p>\n<p>6).\tBeing<br \/>\naggrieved and dissatisfied with the said order of Appellate Court<br \/>\ndated 1.12.2009, the present second appeal is preferred raising the<br \/>\naforesaid substantial questions of law.\n<\/p>\n<p>7).\tShri<br \/>\nG.H. Bhatt, learned advocate appearing for the appellant contended<br \/>\nthat the defect in pleading cannot be held against the plaintiff for<br \/>\ndenying him relief.  The plaintiff though has made prayer in the suit<br \/>\nfor regularization but, in fact, sought declaration of title on the<br \/>\nsuit land as could be seen from the prayer in the plaint.\n<\/p>\n<p>8).\tShri<br \/>\nBhatt further contended that the Revenue Proceedings are not to<br \/>\ngovern the party&#8217;s right  with regard to title if any on the land and<br \/>\nthat being a clear legal position, the Appellate Court ought not to<br \/>\nhave heavily relied upon the revenue proceedings or its finding for<br \/>\ndenying the relief to the plaintiff and accepted the submissions of<br \/>\nthe State  for quashing and setting aside the judgment and decree<br \/>\npassed by the Trial Court.\n<\/p>\n<p>9).\tShri<br \/>\nBhatt learned advocate appearing for the plaintiff-appellant further<br \/>\nsubmits that the appellant has acquired title by way of adverse<br \/>\npossession of the suit land since more than 60 years and, therefore,<br \/>\nhis possession cannot be disturbed and prayers in the suit should<br \/>\nhave been allowed.\n<\/p>\n<p>10).\tThis<br \/>\ncourt is unable to agree with the submissions made by the learned<br \/>\ncounsel for the appellant.  The position in law is very clear with<br \/>\nregard to the claim of the land and other properties on the basis of<br \/>\nplea of adverse possession.  The concept of adverse possession and<br \/>\nits efficacy is to be looked<br \/>\ninto from the angle of party&#8217;s right to continue the possession<br \/>\nwithout any disturbance on account of sufferance of the party who has<br \/>\na legitimate right title and authority over the subject land.  In<br \/>\nthe instance case, the other party against whom, the adverse<br \/>\npossession is put up as a plea being<br \/>\na State, the concept of adverse possession would have to be<br \/>\nappreciated in light of the status of the parties in the suit.<br \/>\nMoreover, it cannot be lost sight of the fact that revenue authority<br \/>\ndid issue notice of eviction as it was treated as encroachment and<br \/>\nthe revenue proceedings have attained its finality as the final order<br \/>\npassed in the revenue proceedings by the authority has remained<br \/>\nunchallenged.  In other words, it can be said that the order passed<br \/>\nby the revenue secretary i.e State has attained finality as it has<br \/>\nnot been challenged in any proceedings by the plaintiff.  The<br \/>\nquestion with regard to seeking relief from the court of law on the<br \/>\nbasis of plea of the  adverse possession is though ingenious, not<br \/>\nacknowledged under the provisions of law and, therefore, this court<br \/>\nis of the view that the questions framed are not substantial<br \/>\nquestions of law  which warrants any interference with the judgment<br \/>\nand order passed by the Appellate Court.\n<\/p>\n<p>11).\tThe<br \/>\nsubstantial questions of law is answered hereinabove<br \/>\nby the aforesaid discussion and, therefore,<br \/>\nno elaborate discussion is required answering separately each and<br \/>\nevery question framed hereinabove.  In the result, the appeal fails<br \/>\nhaving no merits.  No order as to costs.\n<\/p>\n<p>12).\tIn<br \/>\nview of the order passed in Second Appeal No.34 of 2010, no order in<br \/>\ncivil application.
