Justice R.BASANT\n\n Dated :26\/09\/2007\n\n O R D E R\n                          R.BASANT, J.\n                       ----------------------\n                       B.A.No.5807 of 2007\n                   ----------------------------------------\n           Dated this the 26th day of September 2007\n\n\n                              O R D E R\n<\/pre>\n<p>      Application for regular bail.                  The petitioner faces<\/p>\n<p>allegations inter alia under Sections 353 and 307 I.P.C and<\/p>\n<p>Section 3 of the PDPP Act. The petitioner had earlier come<\/p>\n<p>before this court seeking anticipatory bail and by order dated<\/p>\n<p>11\/9\/2007 in B.A.No.5439\/2007 the said application for<\/p>\n<p>anticipatory bail was dismissed with observations. This order<\/p>\n<p>must be read in continuation of the said order. I am not hence<\/p>\n<p>adverting to facts in detail. In obedience to the observations in<\/p>\n<p>the order passed in the application for anticipatory bail, the<\/p>\n<p>petitioners surrendered before the learned Magistrate and<\/p>\n<p>sought regular bail on 17\/9\/2007.                 The learned Magistrate<\/p>\n<p>rejected the application.        Consequently, the petitioners are<\/p>\n<p>continuing in custody from 18\/9\/2007.<\/p>\n<p>      2.   The learned counsel for the petitioner prays, the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer and I<\/p>\n<p>am satisfied that regular bail can be granted to the petitioners<\/p>\n<p><span class=\"hidden_text\">B.A.No.5807\/07                    2<\/span><\/p>\n<p>who have remained in custody from 18\/9\/2007 subject to<\/p>\n<p>appropriate conditions.\n<\/p>\n<p>      3.    In the result, this petition is allowed.
