NO. 241 OF 2009\n           = = = = = = = = = = = = = = =\n     Dated this the 23rd day of November, 2009.\n\n                     J U D G M E N T\n<\/pre>\n<p>    This appeal is preferred by the insurance company<\/p>\n<p>against  the   award    of   the  Workmen&#8217;s     Compensation<\/p>\n<p>Commissioner, Thrissur in W.C.C.344\/03.        The appeal is<\/p>\n<p>admitted on the following substantial questions of law:<\/p>\n<blockquote><p>               &#8220;(i) Whether the Commissioner is<\/p>\n<p>         justified in rejecting the application filed by<\/p>\n<p>         the    appellant   to   assess   the   correct<\/p>\n<p>         percentage of loss of earning capacity of the<\/p>\n<p>         applicant, if any?\n<\/p><\/blockquote>\n<blockquote><p>               (ii)  Whether the Commissioner is<\/p>\n<p>         justified in fixing 10% loss of earning<\/p>\n<p>         capacity when the Doctor has assessed only<\/p>\n<p>         6% disability and also without resorting to<\/p>\n<p>         the schedule under the W.C.Act and<\/p>\n<\/blockquote>\n<blockquote><p>               (iii) Whether the Commissioner is<\/p>\n<p>         justified in granting 12% interest on the<\/p>\n<p>         compensation amount from the date of<\/p>\n<p>         application or from the date of accident?&#8221;<\/p>\n<\/blockquote>\n<p>M.F.A. 241 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>     Points:\n<\/p>\n<p>     2.     Heard the learned counsel for the appellant as well<\/p>\n<p>as the applicant before the Compensation Commissioner. It<\/p>\n<p>is the case of the applicant that while he was loading granite<\/p>\n<p>stones in a lorry his leg slipped and he fell down resulting in<\/p>\n<p>serious injuries such as a cut injury on the left thumb etc.<\/p>\n<p>The Compensation Commissioner has fixed the loss of<\/p>\n<p>earning capacity at 10%, income at Rs.3,300\/-, fixed the<\/p>\n<p>compensation and awarded interest at the rate of 12% from<\/p>\n<p>the date of accident. All these points are challenged before<\/p>\n<p>this Court.\n<\/p>\n<p>     3.     I find in very many cases that the Compensation<\/p>\n<p>Commissioner rejected the application when it is filed for<\/p>\n<p>referring a person to a Medical Board. They do not accept<\/p>\n<p>the disability given by the Doctor and ultimately they reach a<\/p>\n<p>conclusion of their on to fix the loss of earnings capacity. I<\/p>\n<p>am afraid that the said approach is totally erroneous in the<\/p>\n<p>M.F.A. 241 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>light of the large number of decisions rendered by this Court<\/p>\n<p>and especially the latest Full Bench decision reported in<\/p>\n<p><a href=\"\/doc\/1848699\/\">Vanajakshan v. Joseph<\/a> (2003 (2) KLT 462).                The<\/p>\n<p>learned Judges of this court on an exhaustive consideration<\/p>\n<p>of the materials held as follows.\n<\/p>\n<p>           &#8220;The     compensation      has    to    be<\/p>\n<p>           determined with reference to the loss<\/p>\n<p>           in earning capacity and not the ability<\/p>\n<p>           to perform the duties of the job, which<\/p>\n<p>           was being done by the workman at the<\/p>\n<p>           relevant time. The compensation has<\/p>\n<p>           to be assessed on the basis of the<\/p>\n<p>           percentage of the loss of earning<\/p>\n<p>           capacity. While determining the loss<\/p>\n<p>           of earning capacity the authority has<\/p>\n<p>           to keep in view the loss of capacity of<\/p>\n<p>           a workman &#8220;for all work which he was<\/p>\n<p>           capable of performing&#8221; and not for the<\/p>\n<p>           work which he was actually doing.&#8221;\n<\/p>\n<p>Thereafter only after permitting the parties to adduce<\/p>\n<p>M.F.A. 241 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:4:-<\/span><\/p>\n<p>evidence the compensation has to be fixed. So the loss of<\/p>\n<p>earning capacity has to be arrived on the basis of the<\/p>\n<p>materials which would show regarding the incapacity of the<\/p>\n<p>person to do all the work which he was capable of<\/p>\n<p>performing.    But it is not in that angle the matter is<\/p>\n<p>considered but the Compensation Commissioner jumps to a<\/p>\n<p>conclusion and decides it.       So it is necessarily to be<\/p>\n<p>interfered with. Since the matter is going back the question<\/p>\n<p>of interest can also be considered on the basis of the latest<\/p>\n<p>decision available on that point at that time.<\/p>\n<p>      In the result the award under challenge is set aside and<\/p>\n<p>the   matter   is   remitted  back    to   the Compensation<\/p>\n<p>Commissioner with a direction to refer the person to a<\/p>\n<p>Medical Board to assess the loss of earning capacity as<\/p>\n<p>contemplated in the decision reported in <a href=\"\/doc\/1848699\/\">Vanajakshan v.<\/p>\n<p>Joseph<\/a> (2003 (2) KLT 462 and then permit the parties to<\/p>\n<p>adduce evidence in support of their respective contentions<\/p>\n<p>M.F.A. 241 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:5:-<\/span><\/p>\n<p>and thereafter dispose of the matter in accordance with law<\/p>\n<p>including the rate of interest as covered by the decision at<\/p>\n<p>that point of time. At any rate 30% of the amount in deposit<\/p>\n<p>shall be disbursed to the applicant.      The Compensation<\/p>\n<p>Commissioner is directed to fix a date of appearance and<\/p>\n<p>inform the parties for further proceeding with the matter.<\/p>\n<p>                            M.N.
