2.   13.9.2010                Heard learned counsel for the petitioner and<\/p>\n
                 the State.\n<\/p>\n
                              The issue relates to grant of five additional<\/p>\n
                 marks based on the NCCB certificate for selection on the<\/p>\n
                 post of Constable.\n<\/p>\n
                              Strong reliance has been placed on an order<\/p>\n
                 of this Court in C.W.J.C. No. 16285 of 2007, affirmed in<\/p>\n
                 L.P.A. No. 821 of 2008 and analogous cases.<\/p>\n
                              Counsel for the State very fairly submits that<\/p>\n
                 if the petitioner was similarly situated on facts, he is<\/p>\n
                 entitled to the same treatment.\n<\/p>\n
                              The application is disposed in terms of the<\/p>\n
                 aforesaid orders of this Court for examination of the<\/p>\n
                 claims of the petitioner for similarity on facts and a<\/p>\n
                 reasoned and speaking order be passed within a<\/p>\n
                 maximum period of three months from the date of
\n            receipt\/production of a copy of this order.<\/p>\n
                       If the respondent no. 3 proposes to hold that<\/p>\n
           the petitioner is not similarly situated, they are required<\/p>\n
           to disclose the reasons to him, grant him a personal<\/p>\n
           hearing and then pass a reasoned and speaking order on<\/p>\n
           the issue of distinction to facilitate judicial review, should<\/p>\n
           the need arise.\n<\/p>\n
                       The writ application stands disposed.<\/p>\n
