On the first occasion, as the Court was<br \/>\n\trequested by the learned counsel appearing for the respondent that<br \/>\n\tthe present proceedings may be conducted in my Chamber, the<br \/>\n\tproceedings are taken up for hearing in the Chamber.  On 06th<br \/>\n\tMarch 2009 also, the proceedings of the matter were conducted in the<br \/>\n\tChamber.\n<\/p>\n<p>\tShri<br \/>\n\tAmrish Pandya, learned counsel appearing for the petitioner, and<br \/>\n\tShri Hemang Shah, learned counsel appearing for the respondent, are<br \/>\n\tpresent. It is submitted by Shri Hemang Shah, learned counsel<br \/>\n\tappearing for respondent, that Shri Shalin Mehta and himself, may be<br \/>\n\tpermitted to retire from the as learned counsel appearing for the<br \/>\n\trespondent-Sujit Munshi for their personal reasons.\n<\/p>\n<p>\tThe<br \/>\n\trequest is accepted. Shri Shalin Mehta and Shri Hemang Shah, learned<br \/>\n\tcounsel appearing for the respondent, are permitted to retire from<br \/>\n\tthe matter from the next date of hearing. So on the next date of<br \/>\n\thearing, the respondent can arrange for his counsel. The respondent,<br \/>\n\twho is present in the court, is made to understand that as now Shri<br \/>\n\tShalin Mehta and Shri Hemang Shah are permitted to retire from this<br \/>\n\tcase by this Court, and the respondent shall have to arrange for<br \/>\n\tanother counsel, if he so desires, to defend himself by an advocate.\n<\/p>\n<p>\tPassing<br \/>\n\tof this order automatically shall not take out the school<br \/>\n\tauthorities from the obligation of arranging a meeting of the<br \/>\n\tpetitioner with the minor child Akshada. The Court is informed that<br \/>\n\ttill date the intimation in respect of a Sunday convenient to the<br \/>\n\tinstitution, has not been received by the petitioner. It is expected<br \/>\n\tthat the Sarvanaman Vidya Mandir shall comply with the earlier<br \/>\n\tdirections issued by this Court in presence of its representative.\n<\/p>\n<p>\tI<br \/>\n\thave received an R.P.A.D. letter dated 12th March 2009<br \/>\n\talong with annexures, addressed to me by the respondent, including<br \/>\n\tthe report of one consulting Pediatrician Dr.Anil Chikermane. The<br \/>\n\tsaid letter dated 12th March 2009 along with annexures is<br \/>\n\ttaken on record and the same is ordered to be kept in the file of<br \/>\n\tpresent petition.\n<\/p>\n<p>\tWhen<br \/>\n\tthis matter was taken up for hearing on 06th March 2009,<br \/>\n\tthe petitioner in presence of all the concerned persons, including<br \/>\n\tthe respondent, was asked not to address any letter directly to the<br \/>\n\tCourt. The displeasure of the Court was also expressed saying that<br \/>\n\tsuch letters are treated as implied attempt to influence the Court.<br \/>\n\tAll the papers received with the letter addressed by the petitioner<br \/>\n\ton earlier occasion, were decided to be kept on record, so that the<br \/>\n\tlearned counsel appearing for the respondent can read the contents<br \/>\n\tof the letter, notes and other details and after perusing those<br \/>\n\tpapers can make himself aware. The learned counsel defending the<br \/>\n\trespondent may not feel anything like hide and seek game on account<br \/>\n\tof the letter addressed to the Court by the petitioner.\n<\/p>\n<p>\tIt<br \/>\n\tis a matter of great shock and surprise that the respondent claiming<br \/>\n\tto be an educated person has committed similar error, perhaps<br \/>\n\tintentional, by addressing the aforesaid letter dated 12th<br \/>\n\tMarch 2009. The plain reading of the letter takes me to a conclusion<br \/>\n\tprima facie that the respondent intends to put pressure on the<br \/>\n\tPresiding Judge of this Court i.e. myself, so that the Court may<br \/>\n\tleave the matter or may say something, under pressure in favour of<br \/>\n\tthe respondent. This is a case where the petitioner has approached<br \/>\n\tthis Court with a grievance along with other grievances that he may<br \/>\n\thave with third party.\n<\/p>\n<p>\tThe<br \/>\n\trespondent has conveniently shifted her minor child Akshada to<br \/>\n\tBharuch, so that the petitioner may not see the minor child or can<br \/>\n\tget consent decree executed conveniently, though a specific right<br \/>\n\twas created in her favour in a compromised decree, taking the<br \/>\n\tshelter of one event that the petitioner had left India for some<br \/>\n\tshort span of time.\n<\/p>\n<p>\tTrue<br \/>\n\tit is that independent proceedings under Section 26 of the Hindu<br \/>\n\tMarriage Act have been initiated to get modified the consent decree<br \/>\n\tpassed between the parties, however, till date the compromised<br \/>\n\tdecree is an enforceable order and, therefore, it appears that the<br \/>\n\trespondent may have decided to adopt unhealthy tactics of addressing<br \/>\n\tletter of the nature which has been received by this Court by<br \/>\n\tR.P.A.D. It is not a matter of dispute that the aforesaid letter<br \/>\n\tdated 12th March 2009 is received from and written by<br \/>\n\trespondent no.1.\n<\/p>\n<p>\tThis<br \/>\n\tact of respondent, if the letter is read as it is, is nothing but an<br \/>\n\tattempt to hamper the smooth hearing of the case and a Presiding<br \/>\n\tOfficer can be placed under embarrassment making indirect<br \/>\n\tallegations. Such a conduct is prima facie contemptuous and,<br \/>\n\ttherefore, necessary proceedings in such or similar cases should be<br \/>\n\tinitiated and, therefore, this Court is inclined to initiate the<br \/>\n\tcontempt proceedings against the respondent herein,  Suo Motu.\n<\/p>\n<p>\tThe<br \/>\n\trespondent herein has tried to suggest indirectly that as respondent<br \/>\n\thad some dispute or grievance with one Shri Haldar, Officer of the<br \/>\n\tState Government serving in I.A.S. Cadre, and, therefore, the<br \/>\n\tproceedings may have taken present shape and that which the<br \/>\n\trespondent is not able to understand. This impliedly suggests that<br \/>\n\tthe proceedings before this Court are being conducted, perhaps<br \/>\n\taccording to respondent, on account of that officer i.e. Mr.Haldar.\n<\/p>\n<p>\tAs<br \/>\n\tsuch in the present petition, the question of difference of opinion<br \/>\n\tor quarrel between the petitioner and Mr.Haldar has no relevance.<br \/>\n\tWelfare of the minor child, Akshada, ultimately is of paramount<br \/>\n\tconsideration. In such or similar cases and when the Court is aware<br \/>\n\tthat the respondent has married to one another lady, it is the duty<br \/>\n\tof the Court to know the status, heath, age, education and other<br \/>\n\taspects of the lady who married with the respondent after divorce<br \/>\n\twith the petitioner, because relation between the petitioner and the<br \/>\n\tminor child Akshada would be of mother  and daughter, whereas the<br \/>\n\trelation between the  minor child Akshada and present wife of<br \/>\n\trespondent would be of daughter and a step-mother respectively. In<br \/>\n\tsuch a situation, the Court is supposed to inquire into certain<br \/>\n\tdetails. However, it appears that the respondent has skillfully<br \/>\n\tattempted with some motive to tag the queries raised by the Court to<br \/>\n\tthe respondent and his quarrel\/dispute with Mr.Haldar. The totality,<br \/>\n\ttherefore, has taken me to a decision that the contempt proceedings<br \/>\n\tare required to be initiated against the respondent.\n<\/p>\n<p>\tThe<br \/>\n\tRegistry is directed to initiate Contempt of Court proceedings<br \/>\n\tagainst respondent herein. A copy of the present order as well as a<br \/>\n\txerox copy of the aforesaid letter dated 12th March 2009<br \/>\n\taddressed by the respondent herein received by this Court, be sent<br \/>\n\tto the Bench taking up Contempt matters, after obtaining appropriate<br \/>\n\torders from Hon&#8217;ble the Chief Justice, if need be.\n<\/p>\n<p>\tAt<br \/>\n\tthe outset, it is relevant to note that as per the Roster, number of<br \/>\n\tmatters are being listed everyday and the present dispute being a<br \/>\n\tdispute between the litigants who were once husband and wife and as<br \/>\n\tthere was scope to call minor child Akshada in the Court, it was<br \/>\n\trightly submitted by Shri Shalin Mehta, learned counsel appearing<br \/>\n\tfor the respondent, that instead of open Court room, the proceedings<br \/>\n\tmay be heard and decided in the Chamber, otherwise the parties may<br \/>\n\tnot be be able to place their say satusfactorily, more particularly,<br \/>\n\twhen the allegations and counter-allegations against each other<br \/>\n\t(petitioner and respondent) are of sensitive nature, and the<br \/>\n\tsuggestion was accepted at the  instance of respondent.\n<\/p>\n<p>\tAs<br \/>\n\tthe learned counsel appearing for the respondent are not able to<br \/>\n\tmake submissions on merit today, it would not be either proper,<br \/>\n\tjustified or appropriate to pass further orders in reference to the<br \/>\n\tregular meetings further of the petitioner with the minor child<br \/>\n\tAkshada and fixation of time table of meeting of minor child Akshada<br \/>\n\tand petitioner during school vacation hearing needs to be adjourned.<br \/>\n\tThis is a case where possibly this Court even can direct the<br \/>\n\trespondent to see that the minor child Akshada is again admitted in<br \/>\n\tone of the schools at Vadodara City, so that the purpose of<br \/>\n\tcompromised decree may not get frustrated or defeated, however, such<br \/>\n\tan order normally should be passed after affording all the<br \/>\n\topportunities to the other side and, therefore, today the Court is<br \/>\n\tnot inclined to pass any orders in this regard though the same is<br \/>\n\tpressed by Shri Amrish Pandya, learned counsel appearing for the<br \/>\n\tpetitioner.\n<\/p>\n<p>\t \t\tHence,<br \/>\n\tin the interest of justice, the matter is adjourned to 13th<br \/>\n\tApril 2009.\n<\/p>\n<p>(C.K.\n<\/p>\n<p>Buch, J)<\/p>\n<p>Aakar<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Shilpa vs Sujit on 18 March, 2009 Author: C.K.Buch,&amp;Nbsp;
