This appeal is directed against the judgment and<br \/>\n       order dated 27.4.1999 passed by the learned 1st Additional Sessions<br \/>\n       Judge, Cuttack in Sessions Trial No.220 of 1997 convicting the<br \/>\n       appellant under section 302 I.P.C. and sentencing him to undergo<br \/>\n       imprisonment for life and to pay fine of Rs.25,000\/- in default to<br \/>\n       undergo R.I. for two years.\n<\/p>\n<p>       2.                    The case of the prosecution is that on 17.10.1996<br \/>\n       at about 3 P.M., the father of the informant (P.W.3) had been to his<br \/>\n       land to put &#8220;GARVANA STICK&#8221;, but he did not return. The informant<br \/>\n       went in search of his father and found him lying in the maize field<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>having injuries on his head and neck.           He lodged F.I.R. before the<br \/>\nKissannagar Police Station suspecting the present appellant and his<br \/>\nparents to be the assailants of his father. After investigation charge<br \/>\nsheet was filed against the present appellant and two others (parents<br \/>\nof the appellant).\n<\/p>\n<p>3.                    The plea of the present appellant is complete denial<br \/>\nof the allegations.\n<\/p>\n<p>4.                    In order to substantiate the charge, prosecution<br \/>\nexamined as many as seven witnesses including the doctor and the<br \/>\nI.O. and exhibited 23 documents. The defence examined one witness.\n<\/p>\n<p>5.                    The learned Additional Sessions Judge having<br \/>\nregard to the facts of the case, the evidence on record, leading to<br \/>\nrecovery under section 27 of the Evidence Act and corroboration<br \/>\nmade by D.W.1 in respect of recovery of weapons of offence came to<br \/>\nhold that the prosecution has been able to complete the chain of<br \/>\ncircumstance in order to bring home the charge against the present<br \/>\nappellant and convicted and sentenced him as stated earlier.              He,<br \/>\nhowever, acquitted the other two accused persons with the finding<br \/>\nthat the prosecution has miserably failed to prove the charge against<br \/>\nthem.\n<\/p>\n<p>4.                    Mr. Mulia, learned counsel for the appellant,<\/p>\n<p>assails the impugned judgment on the following grounds:\n<\/p>\n<blockquote><p>        (i)           admittedly there is no eye-witness to the<br \/>\n        occurrence and the case solely rests on circumstantial<br \/>\n        evidence;\n<\/p><\/blockquote>\n<pre>        (ii)          the   prosecution   has    not   been   able   to\n        complete the chain of circumstance;\n\n        (iii)         there is no independent corroboration to the\n<\/pre>\n<blockquote><p>        story relating to leading to recovery of the weapon of<br \/>\n        offence;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<blockquote><p>      (iv)           the so-called confessional statement cannot<br \/>\n      be accepted as it does not contain signature of the<br \/>\n      accused or the witnesses;\n<\/p><\/blockquote>\n<blockquote><p>      (v)            the prosecution has not produced nor proved<br \/>\n      the material object before the trial court; and<\/p>\n<\/blockquote>\n<blockquote><p>      (vi)           P.W.4, who is said to be a witness to the<br \/>\n      seizure of weapon of offence, has not supported the<br \/>\n      same.\n<\/p><\/blockquote>\n<p>5.                   Mr.   Nayak,   learned   Additional   Government<br \/>\nadvocate in response submits that the prosecution has been able to<br \/>\ncomplete the chain of circumstances. P.Ws.2, 3 and 5 have clearly<br \/>\nestablished the motive behind the murder. Ten to fifteen days prior to<br \/>\nthe occurrence, the appellant and other accused persons had<br \/>\nassaulted the deceased.      The weapon of offence, i.e., Katari, was<br \/>\nrecovered at the instance of the appellant in presence of the<br \/>\nwitnesses.    The witnesses as well as the appellant have put their<br \/>\nsignature on the seizure list (Ext.3).         The appellant led the<br \/>\nInvestigating Officer to the place of concealment and gave recovery of<br \/>\nthe Katari. P.W.6, the doctor, in his examination-in-chief has opined<br \/>\nthat the cut wounds as described in the post-mortem report can be<br \/>\ncaused by such a weapon, i.e., a katari. Therefore, no fault can be<br \/>\nfound in the impugned judgment convicting the appellant under<br \/>\nsection 302 I.P.C.\n<\/p>\n<p>6.                   Perused the deposition of witnesses and the<br \/>\nexhibits. P.W.1 is said to be an eye-witness but he has not supported<br \/>\nthe prosecution case. Although the prosecution declared him hostile<br \/>\nand put leading questions, nothing has been elicited from him to<br \/>\nsupport its case. P.W.2 is the wife of the deceased Sarat Chandra<br \/>\nDas. She stated in her evidence that on the date of occurrence her<br \/>\nhusband had been to their land to fix &#8220;GARVANA STICK&#8221; as per the<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>tradition but till 5 P.M. he did not return. Her son went in search of<br \/>\nhis father and found him lying dead in the land. She has also stated<br \/>\nthat the appellant was absorbed in a temporary Government service<br \/>\nat Kendrapara due to the arrangement made by her husband.<br \/>\nSubsequently, after the appellant lost his temporary service, there<br \/>\nwas ill-feeling between the appellant and her husband. In her cross-<br \/>\nexamination P.W.2 stated that since her husband filed a case for<br \/>\nrestitution of conjugal rights, she filed a maintenance case against<br \/>\nher husband.          She also admitted that she had not informed the<br \/>\npolice about entry of the appellant and one Khirod into her house<br \/>\nbeing armed with Tenta. She also admitted that there was ill-feeling<br \/>\nbetween them. P.W.3, the informant, is the son of the deceased. He<br \/>\nhas corroborated the statement of her mother.           It is further stated<br \/>\nthat he lodged F.I.R. Ext.2 before Kissannagar Police Station.              In<br \/>\ncross-examination he admitted that 15 days before the occurrence<br \/>\nthe appellant entered into his house with Tenta but he did not inform<br \/>\nthis fact before the police.     P.W.4 is the witness to the seizure to<br \/>\nrecovery of weapon of offence, i.e., Katari. He has not supported the<br \/>\nprosecution case. He was declared hostile and thereafter leading<br \/>\nquestions were put to him. He admitted his signature in the seizure<br \/>\nlist   but     in   cross-examination   he   specifically   stated   that   on<br \/>\n24.10.1996, i.e., the date preceding to the date of seizure, being<br \/>\nshown by the police he traced the knife in the school field near the<br \/>\ndamaged latrine and seizure list was prepared and he put his<br \/>\nsignature. With regard to leading to recovery of weapon of offence by<br \/>\nthe appellant under section 27 of the Evidence Act he has not stated<br \/>\nanything in his statement.       P.W.5 is another son of the deceased.<br \/>\nP.W.6 is the doctor who conducted autopsy over the dead body of the<br \/>\ndeceased and found the following injuries :\n<\/p>\n<blockquote><p>             (i)     Cut wound of size 13 cm. long with a gap of 12<br \/>\n                     cm. on extended neck and involves up to a<br \/>\n                     depth of pharynx, where the wound has cut<br \/>\n                     through and through the skin underline<br \/>\n<span class=\"hidden_text\">                               5<\/span><\/p>\n<p>                 muscles and vessels on front and left side of<br \/>\n                 neck, the 4th cervical vertebral body along with<br \/>\n                 spinal cord and situated by encircling the front<br \/>\n                 and left side of the neck;\n<\/p><\/blockquote>\n<blockquote><p>         (ii)    Cut wound 3 cm. x 1 cm. x superficial muscle<br \/>\n                 deep situated in front of right shoulder vertically<br \/>\n                 3.5 cm. outer and below the lateral end of right<br \/>\n                 clavicle.\n<\/p><\/blockquote>\n<blockquote><p>         (iii)   Cut wound 8 cm. length cutting 4 cm. in depth<br \/>\n                 with a gap of 1 cm. situated transversely and<br \/>\n                 little obliquely in the postero lateral aspect of<br \/>\n                 right fore arm 16.5 cm. above the lower end of<br \/>\n                 radius.\n<\/p><\/blockquote>\n<blockquote><p>         (iv)    Pressure abrasion of size 4 cm. x 1 cm. with<br \/>\n                 black coloured skin over it situated on the ulnar<br \/>\n                 boarder of right fore arm 2 cm. behind the outer<br \/>\n                 end of injury no.(iii).\n<\/p><\/blockquote>\n<blockquote><p>         (v)     Cut wound 4 cm. x 0.75 cm. x bone deep<br \/>\n                 situated in an antero posterior direction 4 cm.<br \/>\n                 above the mid point of left eye brow little<br \/>\n                 obliquely.\n<\/p><\/blockquote>\n<blockquote><p>         (vi)    Cut wound 8 cm. x 1 cm. x bone deep situated<br \/>\n                 over the right parietal region of the head at the<br \/>\n                 level of parietal eminence 5 cm. behind the<br \/>\n                 injury no.(vii).\n<\/p><\/blockquote>\n<blockquote><p>         (vii)   Cut wound 10 cm. x 1.5 cm. x bone deep<br \/>\n                 situated on right fronto parietal region of the<br \/>\n                 head 8 cm. above the root of right ear.\n<\/p><\/blockquote>\n<p>The doctor opined that all the injuries were ante-mortem in nature<br \/>\nand all the injuries, when considered together were fatal in ordinary<br \/>\ncourse of nature. The external injuries would have been caused by<br \/>\nany heavy or moderately heavy cutting weapon.        Nothing has been<br \/>\nelicited from his cross-examination by defence.        It is specifically<br \/>\nstated by the doctor that death of deceased occurred due to combined<br \/>\neffect of haemorrhage, shock and complete transection of spinal cord.\n<\/p>\n<p><span class=\"hidden_text\">                                       6<\/span><\/p>\n<p>       7.                  There is no dispute that the deceased Sarat<br \/>\n       Chandra Dash was lying with cut injuries on the head and neck.<br \/>\n       Information given regarding leading to discovery should be recorded<br \/>\n       and proved and if not so recorded, the exact information must be<br \/>\n       adduced through evidence. In the instant case, the information given<br \/>\n       by the accused has not been recorded nor proved and only the seizure<br \/>\n       list has been proved. No independent corroboration is there to<br \/>\n       support the prosecution case. Ext.16, the disclosure statement, on<br \/>\n       which much reliance has been placed by the trial court, does not<br \/>\n       contain the signature of the witness or the accused. The station diary<br \/>\n       entry has not been proved by the investigating officer. Though the<br \/>\n       conviction has been based on circumstantial evidence, the chain of<br \/>\n       circumstances is not complete. Only evidence available against the<br \/>\n       accused is that there was ill-feeling between the deceased and the<br \/>\n       present appellant. The claim of the prosecution regarding leading to<br \/>\n       recovery under section 27 of the Evidence Act has not been supported<br \/>\n       by any independent witness. No exact information has also been<br \/>\n       adduced through evidence that the accused led the police to the place<br \/>\n       of concealment and gave recovery of the weapon of offence.            The<br \/>\n       weapon of offence, i.e., Katari, was not produced and also not proved<br \/>\n       by the prosecution. In the circumstances, this Court opines that no<br \/>\n       conviction can be based on the evidence adduced\/produced by the<br \/>\n       prosecution.\n<\/p>\n<p>       8.                  In the result, this appeal is allowed and the order of<br \/>\n       conviction and sentence passed against the appellant is set aside.\n<\/p>\n<p>                                                   &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<\/p>\n<pre>\n                                                   Pradip Mohanty,J\nB.K.PATEL,J.
