As common question of law and
\n\tfacts arise  and as such both petitions arise out of the common
\n\torder passed by the appellate authority, they are being disposed of
\n\tby this common order.\n<\/p>\n
In both these petitions, the
\n\trespective petitioners   have prayed for appropriate writ, order
\n\tand\/or direction, quashing and setting aside the Development
\n\tPermission  dtd.31\/5\/2010 granted by the Chief Executive Officer,
\n\tSurendranagar Area Development Authority granted in favour of the
\n\trespondent No.2 (Annexure-B); order dtd.3\/8\/2010 passed by the
\n\tCollector, Surendranagar in Municipal Case No.34 of 2010
\n\t(Annexure-C) as well as order passed by respondent No.1 in Appeal
\n\tNos.15  and 17 of 2010 dtd.14\/12\/2010 (Annexure-D).\n<\/p>\n
Having heard Mr.C.L. Soni, learned
\n\tadvocate appearing no behalf of the respective petitioners; Mr.R.R.
\n\tMarshal, learned Senior Advocate appearing on behalf of Mr.Satyen
\n\tRawal, learned advocate appearing
\n\ton behalf of the respondent No.2, Mr.Pranav Dave as well as
\n\tMs.Jirgha Jhavweri, learned Assistant Government Pleaders appearing
\n\ton behalf of the State authorities, it appears that the main dispute
\n\twas with respect to granting of Development
\n\tPermission by the Area Development Authority in favour of the
\n\trespondent No.2, permitting the respondent No.2 to put up
\n\tconstruction on the lands in question. It appears that the main
\n\tapprehension on the part of the petitioners   is that the respondent
\n\tNo.2 will put up the construction and use the said construction
\n\tde-hors the sanctioned plan and development permission granted by
\n\tthe respondent No.2.\n<\/p>\n
\tMr.R.R.\n<\/p>\n
\tMarshal, learned senior advocate appearing with Mr.Satyen Rawal,
\n\tlearned advocate appearing on behalf of the respondent No.2, in
\n\twhose favour Development Permission has been granted, has stated at
\n\tthe bar under the instruction of respondent No.2 – Dr.Shreyans
\n\tParamanand Gandhi, who is personally present in the court, that the
\n\trespondent No.2 shall put up the construction and use the same
\n\tstrictly in accordance with Development Permission and sanctioned
\n\tplan. That an Undertaking to that effect is also  filed by the
\n\trespondent No.2 on oath, which reads as under :-\n<\/p>\n
“(1)\tMy
\nconstruction is on my private and independently owned plot and not on
\nthe Society’s plot.\n<\/p>\n
(2)\tMy
\nconstruction is not contrary to the bye-laws of Surendranagar
\nMunicipality<\/p>\n
(3)\tThe
\nconstruction which I have put  up is not contrary to the bye-laws of
\nPrabhat Co-Operative Society (cancelled bye-laws) which have been
\nmischievously shown with a view to misguide the Court.\n<\/p>\n
(4)\tI
\nshall carry out the construction and use the same as per the plans
\nwhich may be sanctioned by the Municipality and after obtaining
\nappropriate permission for use.\n<\/p>\n
(5)\tI
\nstate that running hospital in a residential area is permissible. I
\nfurther state that I, myself, am going to live on the second floor.\n<\/p>\n
(6)\tI
\nfurther undertake that I shall try my best and utmost to see that no
\nnuisance takes place or that beighbours  are not put to any
\ninconvenience.\n<\/p>\n
(7)\tI
\nshall try my best to see that neighbourhood benefits rather than
\nsuffers by this development and that all of under
\nsection  can
\nsurvive harmoniously together.”\n<\/p>\n
Mr.Soni, learned
\n\tadvocate appearing on behalf of the respective petitioners    has
\n\tsubmitted that what is stated in the undertaking by the respondent
\n\tNo.2 is not similar to that of statement made by Mr.R.R. Marshal,
\n\tlearned senior advocate appearing on behalf of the respondent No.2.\n<\/p>\n
\tBe
\n\tthat it may, when a statement has been made on behalf of the
\n\trespondent No.2, recorded hereinabove, that the respondent No.2
\n\tshall not put up the construction and use the same contrary to the
\n\tDevelopment Permission and sanctioned plan, there is no question to
\n\tdoubt the same at this stage.\n<\/p>\n
\tMr.Soni,
\n\tlearned advocate appearing on behalf of the respective petitioners
\n\thas submitted that if the respondent No.2 has to act as per the
\n\tstatement made hereinabove, the petitioners do not press the present
\n\tpetition challenging the Development Permission granted by the  Area
\n\tDevelopment Authority confirmed by the appellate authority, in
\n\tfavour of the respondent No.2 and the petitioners   do not invite
\n\treasoned order.\n<\/p>\n
\tIn
\n\tview of the above, both these petitions are disposed of by directing
\n\tthe respondent No.2 to act as per the statement made by Mr.Marshal,
\n\tlearned senior advocate appearing on behalf of the respondent No.2,
\n\twho is personally present in the Court, which is recorded
\n\thereinabove.\n<\/p>\n
It
\n\tgoes without saying that if in future it is found that the
\n\trespondent No.2 has  put up the construction and use the same
\n\tcontrary to Development Permission and\/or sanctioned
\n\tplan, it will be open for the aggrieved party to approach the
\n\tappropriate authority, which may be considered in accordance with
\n\tlaw and on merits.\n<\/p>\n
\tIt
\n\talso goes without saying that it will always be  open for the
\n\trespondent No.2 to submit  revised Development Permission  and
\n\trevised plan, which shall be considered in accordance with law.
\n\tHowever, no construction and\/or use shall be made by the respondent
\n\tNo.2 unless the Development Permission is granted and  revised plans
\n\tare sanctioned.\n<\/p>\n
\tWith
\n\tthe observations and directions as aforesaid, both these petition
\n\tare dismissed as not pressed.\n<\/p>\n
