WJC No.1029 of 2010\n                         FARHANA KHATOON @ CHANDANI\n                                        Versus\n                              STATE OF BIHAR &amp; ORS\n                                      -----------\n<\/pre>\n<p>3.   1.10.2010                Farhana Khatoon alias Chandani has filed this writ<\/p>\n<p>                 application for commanding the respondent authorities to release<\/p>\n<p>                 her from After Care Home, Gaighat, Patna City and also to allow<\/p>\n<p>                 her to live her conjugal life with her husband Md. Irfan<\/p>\n<p>                 (respondent no. 6). The document which has been annexed with<\/p>\n<p>                 this writ application indicates that the petitioner was produced<\/p>\n<p>                 before the Chief Judicial Magistrate, Vaishali at Hajipur in<\/p>\n<p>                 connection with Desri P.S.Case No. 105 of 2010. Her statement<\/p>\n<p>                 was recorded under Section 164 Cr. P.C. and her age was also<\/p>\n<p>                 assessed by the Medical Board as per the direction of the court.<\/p>\n<p>                 The Chief Judicial Magistrate has assessed her age as 19 years.<\/p>\n<p>                 However, the Medical Officer disclosed in his report her age as<\/p>\n<p>                 17 years and also disclosed that she is carrying pregnancy of 12<\/p>\n<p>                 weeks six days.\n<\/p>\n<p>                              Counsel for the petitioner submits that being major<\/p>\n<p>                 the petitioner solemnized the marriage with respondent no. 6 as<\/p>\n<p>                 per the Muslim law and there is no reason for sending her to<\/p>\n<p>                 Remand Home considering it a case of kidnapping as per the<\/p>\n<p>                 allegation in Desri Police Station Case No. 105 of 2010.<\/p>\n<p>                              As per the direction of this Court, the petitioner<\/p>\n<p>                 Farhana Khatoon alias Chandani has been produced by the<\/p>\n<p>                 Superintendent, In-charge of After Care Home,Gaighat, Patna<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        City. The petitioner&#8217;s husband and mother-in-law are also<\/p>\n<p>        present in Court.\n<\/p>\n<p>                      Under the above facts and circumstances, the<\/p>\n<p>        petitioner Farhana Khatoon alias Chandani is being released to<\/p>\n<p>        go with her family members as per her own choice.
