PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.L.DAVE\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE VIJAY MANOHAR SAHAI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/12\/2010  \n \nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>\tRule.\n<\/p>\n<p>Learned Additional Public Prosecutor, Mr. Pandya waives service of<br \/>\nRule on behalf of the State.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate for the applicant and learned Additional Public<br \/>\nProsecutor for the State.\n<\/p>\n<p>3.\tThis<br \/>\nis an application for suspension of sentence and grant of bail during<br \/>\npendency of the appeal.\n<\/p>\n<p>4.\tApplicant&#8217;s<br \/>\nco-accused Zavarabhai Harjibhai Nayak has been admitted to bail by<br \/>\nthis Court by order dated 19.12.2008 in Criminal Misc. Application<br \/>\nNo.15283 of 2008. The case of the applicant, therefore, deserves to<br \/>\nbe positively considered on the ground of parity.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe above aspects, the application deserves to be allowed and the<br \/>\nsame is allowed. The sentence imposed on the applicant-appellant  by<br \/>\nthe learned Sessions Judge, 3rd Fast Track Court,  at<br \/>\nGodhra by judgment and order dated 11.9.2008 passed in Sessions Case<br \/>\nNo.164 of 2007, is  hereby suspended till final disposal of the<br \/>\nappeal.
