Justice V.GIRI\n\n Dated :06\/06\/2008\n\n O R D E R\n                             V.GIRI, J.\n          -------------------------\n               W.P.(C).No.36478 of 2007 P\n          -------------------------\n             Dated this the 6th day of June, 2008.\n\n\n                          JUDGMENT\n<\/pre>\n<p>          The petitioners are included in the rank list<\/p>\n<p>published by the Public Service Commission for the post<\/p>\n<p>of Women Police Constables on 10.1.2004. They have<\/p>\n<p>approached this court aggrieved by what they perceive as<\/p>\n<p>&#8216;failure&#8217; on the part of the respondents in reporting the<\/p>\n<p>vacancies available in Ernakulam District.<\/p>\n<p>          2. Pursuant to the orders passed by this court, a<\/p>\n<p>statement has been filed by the 3rd respondent.<\/p>\n<p>Paragraph 2 of the statement reads as follows:<\/p>\n<blockquote><p>          &#8220;It is submitted that, as per G.O.(P)No.33\/89\/Home<\/p>\n<p>          dated 10.3.1989 recruitment of police constables to the<\/p>\n<p>          District AR was stopped by Government. Since then<\/p>\n<p>          the vacancies of District AR were filled up by<\/p>\n<p>          transferring the trained and ripe Police Constables<\/p>\n<p>          from Armed Police Battalions. Recruitment vacancies<\/p>\n<p>          in AP Battalion are filled from PSC. When the<\/p>\n<p>          petitioners had submitted a request under Right to<\/p>\n<p>          Information Act seeking information in respect of the<\/p>\n<p>          available vacancies of Women Police Constables in<\/p>\n<p>          Ernakulam District on 7-9-2007 and 15-9-2007 there<\/p>\n<p>          were 41 vacancies of Women Police Constables (40<\/p>\n<p>          vacancies in Kochi City &amp; 1 vacancy in Ernakulam<\/p>\n<p>          Rural).    For these vacancies 43 Women Police<\/p>\n<p>W.P.(C).NO.36478\/07<\/p>\n<p>                                  :: 2 ::\n<\/p><\/blockquote>\n<blockquote><p>\n          Constables, who had completed 9 months basic<\/p>\n<p>          training at Kerala Police Academy, Thrissur, were<\/p>\n<p>          attached    to  Ernakulam      District  vide Order<\/p>\n<p>          No.A5\/7085\/07 dated 19-112007 of Inspector General<\/p>\n<p>          of Police, APBN &amp; TP, Thiruvananthapuram, for 6<\/p>\n<p>          months practical training at the various stations of<\/p>\n<p>          Kochi City and Ernakulam Rural. On completion of 6<\/p>\n<p>          months practical training they will be posted in the<\/p>\n<p>          existing vacancies of Ernakulam District.&#8221;<\/p><\/blockquote>\n<p>          3. In the result, I am not in a position to hold<\/p>\n<p>that there are any vacancies in the post in question,<\/p>\n<p>which remains to be reported as such or that there is any<\/p>\n<p>failure on the part of the respondents to report the<\/p>\n<p>available vacancies.
