JUSTICE MAHESH GROVER<\/p>\n<p>Present:-     Mr. Shailender Sharma, Advocate for the appellant<\/p>\n<p>              Ms. Rajat Goel, AAG, Haryana<\/p>\n<p>MAHESH GROVER, J<\/p>\n<p>              This appeal by the plaintiff is directed against the judgment of<\/p>\n<p>the First Appellate Court dated 18.4.2003.\n<\/p>\n<p>              The plaintiff-appellant during his tenure of service was found<\/p>\n<p>guilty of mis-appropriation after regular inquiry was held against him. After<\/p>\n<p>following the due process of law, the respondents by resorting to the<\/p>\n<p>provisions of Rule 4 compulsorily retired him from service as a measure of<\/p>\n<p>punishment.\n<\/p>\n<p>              The plaintiff-appellant filed a suit that he was entitled to<\/p>\n<p>pension and based his claim on Rule 5.32A.\n<\/p>\n<p>              The respondents who contested the suit pleaded that the<\/p>\n<p>appellant had been compulsorily retired from service as a measure of<\/p>\n<p>punishment and that Rule 4 contemplates compulsory retirement as one of<\/p>\n<p>the major punishment which can be inflicted upon a delinquent employee.<br \/>\n<span class=\"hidden_text\"> RSA No. 103 of 2005                    2<\/span><\/p>\n<p>It was thus contended that since they had resorted to the provisions of Rule<\/p>\n<p>4 therefore, the benefit of pension etc. which is available to a person who is<\/p>\n<p>retired compulsorily pursuant to provisions of Rule 5.32A are not available<\/p>\n<p>to the appellant.\n<\/p>\n<p>             Following issues were struck by the learned Trial Court upon<\/p>\n<p>which the parties led their respective evidence:-<\/p>\n<blockquote><p>             1. Whether the order dated 22.6.1993 passed by defendant no.2<\/p>\n<p>               retiring the plaintiff compulsorily is illegal, null and void and<\/p>\n<p>               liable to be set aside?OPP.\n<\/p><\/blockquote>\n<blockquote><p>             2. Whether the order dated 4.10.93\/6.10.93 are also illegal, null<\/p>\n<p>               and void?OPP.\n<\/p><\/blockquote>\n<blockquote><p>             3. Whether the suit is not maintainable in the present<\/p>\n<p>               form?OPD.<\/p><\/blockquote>\n<p>             4. Relief<\/p>\n<p>             After appraisal of evidence before it, learned Trial Court<\/p>\n<p>decreed the suit of the plaintiff-appellant.\n<\/p>\n<p>             In appeal filed by the State of Haryana the findings of learned<\/p>\n<p>Trial Court were upset by learned First Appellate Court.<\/p>\n<p>             This has resulted in the instant regular second appeal.<\/p>\n<p>             It was contended by the learned counsel for the appellant with<\/p>\n<p>reference to Rule 5.32A that he has completed 21 years of service with the<\/p>\n<p>respondents and consequently he was entitled to the benefit of pension.<\/p>\n<p>             On the other hand, learned counsel for the respondent stated<\/p>\n<p>that Rule 4 provides for compulsory retirement as a measure of punishment<\/p>\n<p>which was awarded to the appellant and since he was granted the<\/p>\n<p>punishment after following the due process of law he could not claim any<br \/>\n<span class=\"hidden_text\"> RSA No. 103 of 2005                     3<\/span><\/p>\n<p>benefit of pension.\n<\/p>\n<p>            I have heard learned counsel for the parties and have perused<\/p>\n<p>the impugned judgment.\n<\/p>\n<p>            Rule 5.32-A is extracted hereunder:-\n<\/p>\n<p>                      (a) A government employee is entitled, on his resignation<\/p>\n<p>      being accepted, to a retiring pension after completing qualifying<\/p>\n<p>      service of not less than 30 years, but a competent authority may<\/p>\n<p>      permit the pension to be granted in Special Cases where the<\/p>\n<p>      qualifying service is not less than 25 years.&#8221;\n<\/p>\n<p>            Similarly, Rule 4 is also extracted hereunder:-<\/p>\n<p>            Penalities (1) the following penalities may, for good and<\/p>\n<p>sufficient reasons and as hereinafter provided be imposed on a Government<\/p>\n<p>employee namely:-\n<\/p>\n<blockquote><p>            Minor Penalities<\/p>\n<\/blockquote>\n<blockquote><p>            (i)       &#8212;&#8212;-\n<\/p><\/blockquote>\n<pre>            (ii)      -------\n            (iii)     -------\n            (iv)      -------\n            (v)       ------\n            Major Penalities\n            (vi)      ------\n            (vii) ------\n            (viii) Compulsory retirement.\n            (ix)      -------\n            (x)       -------\n<\/pre>\n<blockquote><p>            Explanation:- The following shall not amount to a penalty<br \/>\nwithin the meaning of this rule, namely:-\n<\/p><\/blockquote>\n<pre>            (i)       ------\n            (ii)      ------\n            (iii)     ------\n<span class=\"hidden_text\"> RSA No. 103 of 2005                       4<\/span>\n\n            (iv)      ------\n            (v)       ------\n            (vi)      compulsorily retirement of a Government employee in\n<\/pre>\n<p>accordance with the provisions relating to his superannuation or retirement.<\/p>\n<p>            A perusal of the aforesaid provisions of law reflects that both<\/p>\n<p>these provisions are on a separate pedestal; one which contemplates<\/p>\n<p>compulsory retirement of a Government employee in accordance with<\/p>\n<p>provisions relating to his superannuation, retirement or based on the opinion<\/p>\n<p>of the employer who wants to weed out the dead wood and the other ie.<\/p>\n<p>Rule 4 in which compulsory retirement is contemplated as a major<\/p>\n<p>punishment. Both these Rules being independent of each other cannot be<\/p>\n<p>read into each other. There is no denial to the fact that the appellant was<\/p>\n<p>proceeded against departmentally and held guilty of mis-appropriation and<\/p>\n<p>after issuing proper show cause notice and complying with other legal<\/p>\n<p>niceties, he was awarded the major punishment of compulsory retirement by<\/p>\n<p>resorting to the provisions of Rule 4. He is, thus, clearly precluded from the<\/p>\n<p>benefits of Rule 5.32A.          A delinquent employee who suffers a major<\/p>\n<p>punishment for his acts and conduct during the tenure of his service cannot<\/p>\n<p>expect to be rewarded of other benefits and more so when the Rule prohibits<\/p>\n<p>the grant of such a benefit. It has further been contended by learned counsel<\/p>\n<p>for the appellant that according to Rule 6.162 there is no bar to his being<\/p>\n<p>granted the pension.\n<\/p>\n<p>            I am afraid that this contention is totally misplaced. Rule 6.16<\/p>\n<p>is also extracted hereunder:-\n<\/p>\n<blockquote><p>                               &#8220;6.16. For Government employees referred to in<\/p>\n<p>            rule 1.2-BH, the amount of superannuation, retiring, invalid and<\/p>\n<p>            compensation gratuity and pension will be the appropriate<br \/>\n<span class=\"hidden_text\"> RSA No. 103 of 2005                  5<\/span><\/p>\n<p>            amount, set out in the table below, and no additional or special<\/p>\n<p>            Additional Pension will be granted:&#8221;<\/p><\/blockquote>\n<p>            The aforesaid Rule contemplates the manner and mode in<\/p>\n<p>which the compensation, gratuity and pension and the appropriate amount to<\/p>\n<p>be awarded is to be given in cases of employees referred to in Rule who<\/p>\n<p>sunperannuate, retire or are invalidated etc. It nowhere contemplates the<\/p>\n<p>grant of pension to delinquent employee who suffers major punishment.<\/p>\n<p>Thus, no ground to interfere is made.
