The conviction  being one  under Section\t 302\nI.P.C.,\t the   sentence\t awarded   namely,   one   of\tlife\nimprisonment, is beyond interference. [2A]\n     2.\t One   of  the\t principal  purposes   of   punitive\ndeprivation  of\t liberty,  constitutionally  sanctioned,  is\ndecriminalization of  the criminal  and restoration  of\t his\ndignity, self-esteem  and good citizenship, so that when the\nman emerges  from the  forbidden gates he becomes a socially\nuseful individual. [2C-E]\n     3. Long  prison terms do not humanise or habilitate but\ndebase\tand  promote  recidivism.  Life\t imprisonment  means\nlanguishing in\tprison for  years and years. Such induration\nof the\tsoul induced by indefinite incarceration hardens the\ninmates, not oftens their responses. [2B]\n     Therefore, the  Court issued  the following  directions\ndesigned to  make the  life  of\t the  sentence\tinside\tjail\nrestorative of\this crippled psyche: (a) despatching the two\nprisoners to  one of  the open\tprisons\t in  U.P.,  if\tthey\nsubstantially fulfil  the  required  conditions;  (b)  being\nagriculturists\tby   profession\t they\tbe  put\t to  use  as\nagriculturists, whether within or without the prison compass\nor them small wages; (c) by keeping the prisoners in contact\nwith their  family them\t small wages;  (c)  by\tkeeping\t the\nprisoners in  contact with  their  family  (i)\tby  allowing\nmembers of  the family\tto visit them and (ii) by permitting\nthe prisoners under guarded conditions at least once a year,\nto visit their families and (d) the prisoners to be released\non parole for two weeks, once a year, which will be repeated\nthroughout their  period  of  incarceration  provided  their\nconduct, while\tat large,  is found to be satisfactory. Rana for the Respondent<br \/>\n     The Order of the Court was delivered by<br \/>\n     KRISHNA IYER,  J.-We are not impressed with the grounds<br \/>\nurged before  us and  so dismiss the Special Leave Petition.<br \/>\nThe conviction\tbeing  one  under  section  302\t I.P.C.\t the<br \/>\nsentence awarded, namely,<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\none  of\t life  imprisonment,  is  beyond  interference.\t The<br \/>\nconviction and sentence must, therefore, stand.\n<\/p>\n<p>     We, however,  notice that\tthe petitioners in this case<br \/>\nare in\ttheir early twenties. We must naturally give thought<br \/>\nto the\timpact on  these two  young lives of a life sentence<br \/>\nwhich means  languishing in prison for years and years. Such<br \/>\ninduration of  the soul\t induced by indefinite incarceration<br \/>\nhardens the  inmates, not softens their responses. Things as<br \/>\nthey are,  long prison\tterms do  not humanise or habilitate<br \/>\nbut debase  and promote\t recidivism. A\thost of other vices,<br \/>\nwhich are  unmentionable  in  a\t judgment,  haunt  the\tlong<br \/>\ncareers of  incarceration, especially when young persons are<br \/>\nforced into  cells in  the company  of callous\tconvicts who<br \/>\nlive in\t sex-starved circumstances Therefore, the conscience<br \/>\nof the\tcourt constrains  it to issue appropriate directions<br \/>\nwhich  are   policy-oriented,  as  part\t of  the  sentencing<br \/>\nprocess, designed  to make  the life  of the sentence inside<br \/>\njail  restorative   of\this  crippled  psyche.\tOne  of\t the<br \/>\nprincipal  purposes  of\t punitive  deprivation\tof  liberty,<br \/>\nconstitutionally sanctioned,  is  decriminalization  of\t the<br \/>\ncriminal and  restoration of  his dignity,  self-esteem\t and<br \/>\ngood citizenship,  so that  when the  man emerges  from\t the<br \/>\nforbidding gates  he becomes  a socially  useful individual.<br \/>\nFrom this angle our prisons have to travel long distances to<br \/>\nmeet the ends of social justice.\n<\/p>\n<p>     In the  present case, we think it proper to direct that<br \/>\nthe State  Government and  the Superintendent  of the Prison<br \/>\nconcerned will\tensure that  the two  prisoners are  put  to<br \/>\nmeaningful employment  and, if permissible, to open prisons,<br \/>\nas an experimental measure. Counsel for the State represents<br \/>\nthat there  are open  prisons in the State of Uttar Pradesh.<br \/>\nWe  direct  the\t State\tGovernment  to\tdespatch  these\t two<br \/>\nprisoners to  one of  the  open\t prisons  in  Uttar  Pradesh<br \/>\nwithout standing  on technical\trules, if substantially they<br \/>\nfulfil the required conditions.\n<\/p>\n<p>     We may  take advantage  of this  opportunity to  make a<br \/>\ngeneral direction  to the  State Government to draw up a set<br \/>\nof rule\t to  reform  the  pattern  of  prison  life  and  to<br \/>\ntransform the  present system  in itself so that the harsher<br \/>\ntechnologies inherited\tfrom imperial times are abandoned in<br \/>\nfavour of  humane processes constitutionally enlivened under<br \/>\nthe Republic.  These days, Prison Commissions are at work in<br \/>\nmany States  and we  do hope that the State of Uttar Pradesh<br \/>\nwill hasten to bring compassion into prisons.\n<\/p>\n<p>     We are  told that\tthe prisoners  are agriculturists by<br \/>\nprofession. It\tis better,  therefore, that  they are put to<br \/>\nuse as\tagriculturists, whether within or without the prison<br \/>\ncompass. Being young, they should also<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\nbe trained  in any other useful craft, if they have aptitude<br \/>\ntherefor, so  that when\t eventually  they  emerge  from\t the<br \/>\nprison walls,  they may become sensitive citizens and not be<br \/>\nan addition  to the  criminals proliferating in the country.<br \/>\nWe think  that when prisoners are made to work, as these two<br \/>\nought to  be under  our directions, a small amount by way of<br \/>\nwages could  be paid  and should be paid so that the healing<br \/>\neffect on  their  minds\t is  fully  felt.  Moreover,  proper<br \/>\nutilisation of\tservices of  prisoners\tin  some  meaningful<br \/>\nemployment, whether  as cultivators  or as craftsmen or even<br \/>\nin creative  labour will be good from the society&#8217;s angle as<br \/>\nit reduces  the burden\ton  the\t Public\t Exchequer  and\t the<br \/>\ntension within.\t Further, the  humanizing  process  will  be<br \/>\nfacilitated by\tkeeping the  prisoners in contact with their<br \/>\nfamily. This can be made feasible (a) by allowing members of<br \/>\nthe family  to visit the prisoners and (b) by the prisoners,<br \/>\nunder guarded  conditions, being  permitted, at least once a<br \/>\nyear, to visit their families. We therefore, direct that all<br \/>\nthese be done by the State Government and the Superintendent<br \/>\nunder the  authority of\t this Court&#8217;s  order. The  prisoners<br \/>\nwill be\t permitted to  go on  parole for  two weeks,  once a<br \/>\nyear, which  will be  repeated throughout  their  period  of<br \/>\nincarceration provided\ttheir conduct,\twhile at  large,  is<br \/>\nfound to  be satisfactory.
