Justice ANTONY DOMINIC\n\n Dated :11\/05\/2007\n\n O R D E R\n                            ANTONY DOMINIC, J.\n\n                           ===============\n\n                       W.P.(C) NO. 14836 OF 2007\n\n                         =================\n\n\n                Dated this the 11th day of May, 2007\n\n\n                                J U D G M E N T\n<\/pre>\n<p>       Petitioner   is   a   registered   dealer   under   the   Kerala   General<\/p>\n<p>Sales   Tax   Act.   Aggrieved   by   Ext.P1   order   of   assessment,   the<\/p>\n<p>petitioner   filed   Ext.P2   appeal   and   Ext.P3   stay   petition.     It   is   the<\/p>\n<p>complaint of the petitioner that during the pendency of the appeal<\/p>\n<p>and the stay petition, revenue recovery proceedings evidenced by<\/p>\n<p>Ext.P4   has   been   initiated   for   the   recovery   of   the   tax   due   under<\/p>\n<p>Ext.P1.     In   the   above   circumstances,   this   writ   petition   has   been<\/p>\n<p>filed,   seeking   inter   alia,   a   direction   to   the   respondents   to   pass<\/p>\n<p>orders  in the appeal, keeping in abeyance the revenue recovery<\/p>\n<p>proceedings.\n<\/p>\n<\/p>\n<p>       Accordingly this writ petition will stand disposed of directing<\/p>\n<p>the   2nd  respondent   to   consider   and   pass   orders   on   Ext.P3   stay<\/p>\n<p>petition with notice to the petitioner within a period of six weeks.<\/p>\n<p>It   is   further   directed   that,   in   the   meanwhile   Ext.P4   revenue<\/p>\n<p>recovery proceedings initiated against the petitioner shall be kept<\/p>\n<p>in abeyance.\n<\/p>\n<\/p>\n<p>       Writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                                 ANTONY DOMINIC, JUDGE.\n<\/p>\n<p>Rp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sunitha Kurian Thomas vs The Sales Tax Officer on 11 May, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 14836 of 2007(N) 1.
