Justice V.GIRI\n\n Dated :24\/10\/2008\n\n O R D E R\n                       V.GIRI, J.\n       -------------------------\n            W.P.(C).No.31484 of 2008\n       -------------------------\n        Dated this the 24th day of October, 2008.\n\n\n                    JUDGMENT\n<\/pre>\n<p>       Petitioner is the registered owner of<\/p>\n<p>a  Lorry  bearing      registration         No.TN-38-AH-<\/p>\n<p>5208, which was seized on the allegation that<\/p>\n<p>it was being used for illegal transportation<\/p>\n<p>of river sand. Petitioner submits that the<\/p>\n<p>petitioner&#8217;s vehicle has nothing to do with<\/p>\n<p>the unauthorised transportation of the sand.<\/p>\n<p>Third respondent is to pass final orders in<\/p>\n<p>terms  of  the      provisions        of     the  Kerala<\/p>\n<p>Protection of River Banks (Protection and<\/p>\n<p>Regulation of Removal of Sand) Act, 2002, and<\/p>\n<p>the Rules framed thereunder. Petitioner has<\/p>\n<p>sought for the release of the vehicle as per<\/p>\n<p>Ext.P1.\n<\/p>\n<p>       Having       heard       learned       Government<\/p>\n<p>Pleader also, the writ petition is disposed<\/p>\n<p>of directing the third respondent to pass<\/p>\n<p>final orders in the matter of seizure and<\/p>\n<p>confiscation of      vehicle belonging           to  the<\/p>\n<p>petitioner bearing registration No.TN-38-AH-<\/p>\n<p>W.P.(C).NO.31484\/08<\/p>\n<p>                      :: 2 ::\n<\/p>\n<p>\n5208, in terms of the provisions of Section<\/p>\n<p>23 of the Act and Rule 27(3) of the Rules,<\/p>\n<p>within a period of two weeks from the date of<\/p>\n<p>receipt of a copy of this judgment.<\/p>\n<p>                                  Sd\/-\n<\/p>\n<p>                                (V.GIRI)<br \/>\n                                 JUDGE<br \/>\nsk\/<\/p>\n<p>         \/\/true copy\/\/<\/p>\n<p>              P.S.
