they came near Jogipatty, Tarnilnadtt  <\/p>\n
time, the driver of the said *Jehic1e drovethe  “in a ”<\/p>\n
rash and negligent manner,lostcoritrol oaverthe Vehicle
\nand caused the accident;’  the claimant
\nsustained   been taken to
\n  to St. Johns Hospital,<\/p>\n
Bangalore’; whcreidiifhe “has. taken-treatment as inpatient for<\/p>\n
four days  oi1.:’vacbcoti’n__f”‘Qf’ the injuries sustained, he<\/p>\n
has suffered –  disability and Doctor has<\/p>\n
 ‘~   the di’s’ab–i1.ity at 40% to the face and at 20% to<\/p>\n
_’the body which is permanent in nature.<\/p>\n
‘i’tierefore;V’Vc}aimant has filed a claim petition before the<\/p>\n
‘*._Tribun_at1’:. under section 166 of M.V. Act, claiming<\/p>\n
“‘-V’_com4’f;rensation against the driver, owner and Insurer of<\/p>\n
  offending vehicle. The said claim petition had come<\/p>\n
up for consideratio ore the Tribunal. The Tribunal<\/p>\n

 arid subniitted that an employee who is being<\/p>\n

vehicle__”is-a’ goods carriage and in the instant case, the<\/p>\n
V   vehicleii’ is a Tata Sumo, a private car and not a goods<\/p>\n
l”‘earriAage and therefore, the liability fastened on the<\/p>\n
l   ‘Insurer is liable to be set aside.<\/p>\n

8. Furtl1erl,Vg:sI’iearned the claimant Sri.
\nT.C.   the Tribunal has
\n‘   awarding reasonable
\ncompensation’  heads on account of the<\/p>\n
injuriesg sulstained ‘by the claimant. Therefore, he<\/p>\n
  that  impugned judgment and award<\/p>\n
 giasseaitfjiby the Tribunal is liable to be modified by<\/p>\n
enhancirig \u00a7’cornpensation reasonably.<\/p>\n
 After hearing the learned counsel for the<\/p>\n
lllnsurer, the claimant and the owner of the vehicle at<\/p>\n
ll ‘ “considerable length of time and after careful perusal of<\/p>\n
new<\/p>\n
 is clearmlfrom reading of section 147 of the<\/p>\n
   of insurance required to be taken in<\/p>\n
  respect’ of the death or bodily injuries arising out of and
\nin the course of employment of every employee of<\/p>\n
l V’  the person insured under the policy. Such liability must<\/p>\n
the materials available on \ufb01le. the points that
\nour consideration are as under: it it i V’ V
\n(1) Whether the liabilityifastenedly ‘
\nby the Tribunal\n<\/p>\n

iyas being used for personal purposes.<\/p>\n

ulsection-147 read with section 146 and Chapter 11 of<\/p>\n
   …_tl1e Act and the law laid down by the Larger Bench of<\/p>\n
this Court in Bhimavva's case (supra), we are of the<\/p>\n

considered view; that, the liability fastened <\/p>\n
Insurance Company is liable to be   <\/p>\n

12. It is the caseof he was aged
\nabout 42   Tribunal has
\nassessed   per month and the
\nsame \ufb02ivttittneeds to be enhanced.
\nTakingxinto the age, occupation and the<\/p>\n
yeargo{_ accident} We “reassess the income of the<\/p>\n
  per month. Further it emerges<\/p>\n
 ‘from  that, claimant has taken treatment as<\/p>\n
inpa.tie1fit’ foi’ four days in the hospital and on account of<\/p>\n
 VVLV.”th:z_.in_\u00a7i3;r:ies he has sustained permanent disability, the<\/p>\n
   assessed the disability of the face” at 40%<\/p>\n
   at 20% to the whalebody. The same is an<\/p>\n
exaggeration and 1\/3″! of 40% would be the wholebody<\/p>\n

disability and it comes to 13.3% and it is rounded”<\/p>\n
14%. Accordingly, we take the disability  ‘<\/p>\n
wholebody instead of 7% as assessed  Ru<\/p>\n
This disability is permanent in nature and’clairr1an’t_l:”ha”s\u00bb.<\/p>\n
to suffer the same through-.,:Vou_t  .lile.V_ar:1d”~–;it”’would ”<\/p>\n
affect his earning C3P\u00a7EitYr=””  it’iS’~the’\u00a7 ease of
\nthe claimant that he   amount
\ntowards medical’:-_   and other
\nincidental  that, on account of
\nthe inji1riesi,ll.l.}\u00a7ve\u00a7v tahkenlfbed rest and follow up
\ntreatmentlforl  during the said period he<\/p>\n
might _vhave”~stistained loss of income as he could not<\/p>\n
 attended l\ufb02hislvwork. The appropriate multiplier<\/p>\n
   as he was aged about 42 years. But all<\/p>\n
thlese aspectsjof the matter have not been considered or<\/p>\n
“.,appreciated by the Tribunal while awarding compensation.<\/p>\n
Taking all these factors into consideration, we award a sum<\/p>\n
 oi”; \u20ac10,000\/– towards medical expenses, conveyance,<\/p>\n
 nourishing food and a ant charges, ?14,400\/w towards<\/p>\n
