This is the plaintiffs  ap’peal.._  <\/p>\n
appellant herein filed. a  declaration and
\ninjunction against  The Trial

   per their rank before
\nthe trialvteourtt.  in t R t<\/p>\n
‘\u00a32; The.’ 1′-eexords ‘reveal that I-ionnagirigowda and<\/p>\n
 are genitive brothers born to Bettegowda.<\/p>\n
 iiivrquestion, i.e., sy.No.50\/1 (New No.615),<\/p>\n
 _ measuririg  acres was purchased by Puttegowda<\/p>\n
  registered sale deed dated 14.5.1932. Since<\/p>\n
the name of Puttegowda is appearing in the<\/p>\n
V’<\/p>\n
– 3-\n<\/p>\n
revenue records. After the demise of Puttegowda, his<\/p>\n
three sons, viz., Thirnmaiah (defendant), Appajie’..::arid<\/p>\n
Thimmappa got divided the family  _<\/p>\n
property in question had fallen M ‘4 W <\/p>\n
Appaji and Thimrnappa. Both <\/p>\n
jointly sold 4 acres of sched*-‘i_Ie.. property in i’a\\dfQ:u.ryVof_:’3the <\/p>\n
defendant herein on  sale
\ndeed and on the very  thlephoon-.,is handed over
\nto the defendant;   in turn has
\nsold 1 acre. certain Chinnappa,
\nS\/ o. hand”lreinainingfportion of 2 acres 20
\nguntas     defendant.\n<\/p>\n
The llplvairitiff-.  the daughter of I-Ionnagiri<\/p>\n
 ,_iGoved:a 13:15\u00bb.filedx’the'”suit for declaration and injunction<\/p>\n
~4t;l1cat_’_.Honnagirigowda has got half share in<\/p>\n
the  question and that Honnagirigowda has<\/p>\n
[T7-‘\u00ab\u00ab___V’execute:1__f*a gift deed in favour of the plaintiff on<\/p>\n
 c:i’\u00e9..1o.:i-‘971. Pursuant to the gift deed, the plaintiff<\/p>\n
P<\/p>\n
claims to be in possession of the property. It is the<\/p>\n
speci\ufb01c case of the plaintiff that the prope~rty..l_l’\u00a7_n<\/p>\n
question was purchased on 14.5.1932 by  ~<\/p>\n
and Honnagirigowda and after such._purchase;.fpbothithe it it<\/p>\n
brothers Honnagirigowda and liuttegoyvdla. <\/p>\n
property equally through oral_  “and ” V<\/p>\n
consequently Honnagirigowda  the “v..owner in
\npossession of 2 acres otdt_he”property_ which is gifted by<\/p>\n
him in favour _of the   2 V’  <\/p>\n
 to show that there
\nwas an oral’L”partitionsbetween I-Ionnagirigowda and
\nPuttegovirda. *  property in question was<\/p>\n
purctiased in  narrxe of Puttegowda as far back as in<\/p>\n
   __ The record of rights stands in the name<\/p>\n
of really the property was purchased for<\/p>\n
 andllllonbpehalf of Honnagirigowda also, there would have<\/p>\n
 “..\ufb02bAee11_sorne documents to show the same or at least the<\/p>\n
‘  lorothers Honnagirigowda and Puttegowda would have<\/p>\n

filed an application to enter their names jointly. In the<\/p>\n
absence of any such material on record, it can_n-otfbe<\/p>\n
presumed that the property was purchased  _<\/p>\n
brothers and that there was an oral partition’  ‘* if<\/p>\n
the two brothers and in the  oral.’ <\/p>\n
Honnagirigowda has got “2”‘-,acres~ of. “Since -. ‘<\/p>\n
Honnagirigowda himself ihaye anyjjtigpvvvibver the
\nproperty in questionif\u00e9hhe. .4 gifted the
\nproperty in “f}’_1y’oi;r iof   the plaintiff.
\nConsequen.-tiy\ufb01pthe   the ownership
\nover the   extent of 2 acres.\n<\/p>\n

   defendant, who is another son of Puttegowda.<\/p>\n

All these facts clearly reveal that….t.he plairitiff  ‘Au<\/p>\n
right over the property in <\/p>\n
