                                   1\/2\n\n               S.B.CIVIL WRIT PETITION NO.6331\/2008\n               (Hari Kishan & anr. vs. Manohar Lal & ors.)\n                     DATE OF ORDER : 5\/10\/2009\n\n               HON'BLE DR.JUSTICE VINEET KOTHARI\n\n\nMr.P.M.Vyas, for the petitioner.\nMr.C.P.Soni, for the respondent.\n\n\n\n      This petition is directed against the order dated 3\/7\/2008,\n\nwhereby, the application under Order 1 Rule 10 CPC filed by the\n\npresent petitioner came to be rejected by the learned trial court.\n\n      The petitioner applicant submitted that the property in question\n\nis a joint Hindu Family property which was under agreement in\n\nquestion and agreed to be sold to the plaintiff. In the present suit for\n\nspecific performance, in order to have say in the matter, he was\n\nnecessary and proper party, therefore, he ought to have been\n\nimpleaded in the suit.\n\n      On the other hand, Mr. Soni submits that since he is stranger to\n\nthe agreement itself, he cannot be impleaded as party to the suit,\n\ntherefore, the learned trial court was justified in rejecting the said\n\napplication.\n\n      Having considered the submissions made at the bar and having\n\ngone through the impugned order, this Court is satisfied that in the\n                                   2\/2\n\nfacts and circumstances of the case, the petitioner-applicant was a\n\nnecessary and proper party in the suit lest it gives rise to further\n\nunnecessary litigation, therefore, he ought to have been impleaded\n\nparty in the suit and be heard in the matter.\n\n      Consequently, this writ petition is allowed and impugned order\n\ndated 3\/7\/2008 passed by the learned trial court is set aside and\n\napplication under Order 1 Rule 10 CPC filed by the present petitioner\n\napplicant is allowed.\n\n\n\n                                          (DR.VINEET KOTHARI),J.\n<\/pre>\n
