LTD - Appellant(s)\n \n\nVersus\n \n\nTHE\nOFFICIAL LIQUIDATOR, GUJARAT SMALL INDUSTRIES &amp; 3 - Respondent(s)\n \n\n=========================================================\n \nAppearance : \nMR\nDAKSHESH MEHTA for\nAppellant(s) : 1, \nMR PV HATHI for Respondent(s) : 1, \nNOTICE\nSERVED for Respondent(s) : 2, 4, \nMS VAIBHAVI K PARIKH for\nRespondent(s) : 2, \nNone for Respondent(s) : 3, \nMR UTPAL M\nPANCHAL for Respondent(s) :\n4, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n\t\n       Date : 24\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this appeal, the appellant has prayed to quash and set aside<br \/>\nthe order passed by the learned City Civil Court in Civil Misc.<br \/>\nApplication No. 19 of 2008 filed in Summary Suit No. 5412 of 1990<br \/>\ndated 15.02.2007, whereby the said application was rejected.\n<\/p>\n<p>2.\t\tThe<br \/>\nlearned counsel for the parties state that the principal amount is<br \/>\nquestion is already paid by the appellant and the only question which<br \/>\nis now required to be considered is with respect to the rate of<br \/>\ninterest.   At this stage the learned counsel for the appellant state<br \/>\nthat the rate of interest awarded by the trial Court is on higher<br \/>\nside and requested this Court to award 6% interest on the principal<br \/>\namount in question. On the other hand learned counsel for respondent<br \/>\nno. 1 state that appropriate orders may be passed keeping in mind the<br \/>\ninterest of both the parties.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. Considering the facts of the case, and considering the<br \/>\nrate of interest prevailing as on today, I am of the opinion that<br \/>\nends of justice would be served by passing the following order.\n<\/p>\n<p>4.<br \/>\nThe appellant is now directed to pay interest at the rate of 7.5%<br \/>\nfrom the date of the filing of the suit.  The appellant shall pay the<br \/>\namount of interest within a period of six months from today. It is,<br \/>\nhowever, observed that the amount deposited by the appellant before<br \/>\nthe Court concerned, the same shall be allowed to be withdrawn and<br \/>\nthat the same shall be given credit against the amount due.\n<\/p>\n<p>5.\t\tWith<br \/>\nthe above directions, the appeal stands disposed of. Notice is<br \/>\ndischarged.
