No.12503 of 2010\n                     RAJ KUMAR YADAV SON OF LATE RAM SARAN YADAV\n                                             Versus\n                                      STATE OF BIHAR\n                                           -----------\n<\/pre>\n<p>4.   24.6.2010               Heard learned Counsel for the petitioner and the State.<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under Section 395 of the Indian Penal Code.<\/p>\n<p>                             It has been submitted that the petitioner is not named<\/p>\n<p>                 in the first information report and subsequently when it transpired<\/p>\n<p>                 that the daughter-in-law of the petitioner was using the sim card of<\/p>\n<p>                 one of the looted Mobiles, the petitioner&#8217;s house was raided and<\/p>\n<p>                 the petitioner was apprehended with the Mobile using the said sim<\/p>\n<p>                 card.\n<\/p>\n<p>                             The submission is the raid was conducted one and half<\/p>\n<p>                 months later and it is quite possible that the petitioner may be a<\/p>\n<p>                 bonafide purchaser of the same.\n<\/p>\n<p>                             In view of such, let the petitioner above named, who is<\/p>\n<p>                 in custody since 8.12.2009, be released on bail on furnishing bail<\/p>\n<p>                 bond of Rs.5,000\/- (Five thousand) with two sureties of the like<\/p>\n<p>                 amount each to the satisfaction of Addl. Chief Judicial Magistrate,<\/p>\n<p>                 Hilsa, Nalanda in Chandi P.S.case No.262 of 2009, subject to the<\/p>\n<p>                 conditions (i) That one of the bailors shall be the son of the<\/p>\n<p>                 petitioner and the other bailor will be a close relative of the<\/p>\n<p>                 petitioner who will give an affidavit giving genealogy as to how he<\/p>\n<p>                 is related with the petitioner. The bailor will undertake to furnish<\/p>\n<p>                 information to the court about any change in the address of the<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            petitioner, (ii) that the bailor shall also state on affidavit that he will<\/p>\n<p>            inform the court concerned if the petitioner is implicated in any<\/p>\n<p>            other case of similar nature after his release in the present case<\/p>\n<p>            and thereafter the court below will be at liberty to initiate the<\/p>\n<p>            proceeding for cancellation of bail on the ground of misuse, (iii) that<\/p>\n<p>            the petitioner will give an undertaking that he will receive the police<\/p>\n<p>            papers on the given date and be present on date fixed for charge<\/p>\n<p>            and if he fails to do so on two given dates and delays the trial in<\/p>\n<p>            any manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>            misuse and (iv) that the petitioner will be well represented on each<\/p>\n<p>            date and if he fails to do so on two consecutive dates, his bail will<\/p>\n<p>            be liable to be cancelled.\n<\/p>\n<\/p>\n<p>                                    ( Anjana Prakash, J. )<\/p>\n<p>Narendra\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Raj Kumar Yadav vs State Of Bihar on 24 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
