SANKARAN, J.\n                      ---------------------------\n                 B.A. Nos. 1415 &amp; 1467 of 2010\n                ----------------------------------------\n              Dated this the 17th day of March, 2010\n\n\n                             O R D E R\n<\/pre>\n<p>      These are applications for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure. Petitioner in Bail<\/p>\n<p>Application No. 1415\/2010 is accused No.1, while the petitioner<\/p>\n<p>in Bail application No. 1467\/2010 is accused No.6 .<\/p>\n<p>      2.   The offences alleged against the petitioners are under<\/p>\n<p>Sections 143, 147, 148, 341, 323, 324, 326 and 308 read with<\/p>\n<p>Section 149 of the Indian Penal Code.\n<\/p>\n<p>      3. The date of occurrence was on 02.09.2009.              The<\/p>\n<p>prosecution case is that the accused persons formed themselves<\/p>\n<p>into an unlawful assembly and attacked the de facto complainant<\/p>\n<p>with an iron rod. The de facto complainant sustained fracture of<\/p>\n<p>his left hand.\n<\/p>\n<p>      4. Heard the learned counsel for the petitioners and the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p>      5. The injury resulting in the fracture is attributable to the<\/p>\n<p>attack made by accused No.1, with an iron rod. The allegation<\/p>\n<p><span class=\"hidden_text\">B.A. Nos. 1415 &amp; 1467 of 2010    2<\/span><\/p>\n<p>against accused No.6 is that he assaulted the de facto<\/p>\n<p>complainant with hand. The grievous hurt caused to the de facto<\/p>\n<p>complainant is not attributable to any overt act done by accused<\/p>\n<p>No.6.\n<\/p>\n<p>      5. In the facts and circumstances mentioned above, I am of<\/p>\n<p>the view that anticipatory bail can be granted to accused No.6.<\/p>\n<p>However, I am not inclined to grant anticipatory bail to accused<\/p>\n<p>No.1(petitioner in B.A. No.1415\/2010). The allegation is that he<\/p>\n<p>had caused grievous hurt to the de facto complainant using an<\/p>\n<p>iron rod. The de facto complainant sustained fracture. In the<\/p>\n<p>facts and circumstances, I am of the view that the first accused<\/p>\n<p>(petitioner in B.A. No. 1415\/2010) is not entitled to the<\/p>\n<p>discretionary relief under Section 438 of the Code of Criminal<\/p>\n<p>Procedure. Bail Application No. 1415\/2010 is therefore, liable to<\/p>\n<p>be dismissed.\n<\/p>\n<p>       Accordingly, there will be a direction that in the event of<\/p>\n<p>the arrest of the petitioner (accused No.6- Pradeep Kumar), the<\/p>\n<p>officer in charge of the police station shall release him on bail on<\/p>\n<p>his executing bond for Rs. 15,000\/- with two solvent sureties for<\/p>\n<p>the like amount to the satisfaction of the officer concerned,<\/p>\n<p><span class=\"hidden_text\">B.A. Nos. 1415 &amp; 1467 of 2010     3<\/span><\/p>\n<p>subject to the following conditions:\n<\/p>\n<blockquote><p>         A) The petitioner in B.A.No. 1467 of 2010(accused<br \/>\n             No.6-Pradeep Kumar) shall report before the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on every Monday for two months.\n<\/p><\/blockquote>\n<blockquote><p>         B) The petitioner in B.A.No. 1467 of 2010 (accused<br \/>\n             No.6-Pradeep Kumar)      shall appear before the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioner in B.A.No. 1467 of 2010 (accused<br \/>\n             No.6-Pradeep Kumar) shall not try to influence<br \/>\n             the prosecution witnesses or tamper with the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioner in B.A.No. 1467 of 2010(accused<br \/>\n             No.6-Pradeep Kumar)      shall not commit any<br \/>\n             offence or indulge in any prejudicial activity<br \/>\n             while on bail.\n<\/p><\/blockquote>\n<blockquote><p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.<\/p><\/blockquote>\n<p>       For the aforesaid reasons,       the Bail Application No.<\/p>\n<p> 1467\/2010 is allowed in the manner indicated above and Bail<\/p>\n<p> Application No. 1415\/2010 is dismissed.\n<\/p>\n<\/p>\n<p>                                   K.T.
