2.      We \u00a0 heard \u00a0 this \u00a0 case \u00a0 through \u00a0 video \u00a0 conferencing. \u00a0 The \u00a0 Appellant \u00a0 was\u00a0<\/p>\n
present\u00a0in\u00a0the\u00a0Gandhinagar\u00a0studio\u00a0of\u00a0the\u00a0NIC.\u00a0The\u00a0Respondents\u00a0were\u00a0present\u00a0<\/p>\n
in\u00a0our\u00a0chamber.\u00a0We\u00a0heard\u00a0their\u00a0submissions.\n<\/p>\n<\/p>\n
3.      In\u00a0its\u00a0order\u00a0dated\u00a028\u00a0August\u00a02009,\u00a0the\u00a0CIC\u00a0had\u00a0remanded\u00a0the\u00a0matter\u00a0to\u00a0<\/p>\n
the \u00a0 first \u00a0 Appellate \u00a0 Authority \u00a0 with \u00a0 the \u00a0 direction \u00a0 that \u00a0 he \u00a0 should \u00a0 pass \u00a0 an\u00a0<\/p>\n
appropriate \u00a0 order \u00a0 within \u00a0 10 \u00a0 days \u00a0 of \u00a0 receiving \u00a0 the \u00a0 orders. \u00a0 The \u00a0 Appellate\u00a0<\/p>\n

\n Authority,\u00a0consequently,\u00a0passed\u00a0an\u00a0order\u00a0on\u00a025\u00a0September\u00a02009.\u00a0It\u00a0is\u00a0against\u00a0<\/p>\n
this\u00a0order\u00a0that\u00a0the\u00a0Appellant\u00a0has\u00a0come\u00a0to\u00a0the\u00a0CIC\u00a0alleging\u00a0that\u00a0the\u00a0Appellate\u00a0<\/p>\n
Authority\u00a0had\u00a0failed\u00a0to\u00a0carry\u00a0out\u00a0the\u00a0directions\u00a0of\u00a0the\u00a0CIC\u00a0and\u00a0provide\u00a0him\u00a0with\u00a0<\/p>\n
the\u00a0right\u00a0information.\n<\/p>\n<\/p>\n
4.      The\u00a0Respondents\u00a0submitted\u00a0that\u00a0the\u00a0Appellate\u00a0Authority\u00a0had\u00a0passed\u00a0a\u00a0<\/p>\n
speaking\u00a0order\u00a0and\u00a0that\u00a0the\u00a0desired\u00a0information\u00a0had\u00a0already\u00a0been\u00a0provided\u00a0to\u00a0<\/p>\n
him \u00a0 in \u00a0 response \u00a0 to \u00a0 similar \u00a0 applications \u00a0 filed \u00a0 by \u00a0 him \u00a0 earlier. \u00a0 The \u00a0 Appellant\u00a0<\/p>\n
argued\u00a0that\u00a0in\u00a0spite\u00a0of\u00a0the\u00a0claim\u00a0of\u00a0the\u00a0Appellate\u00a0Authority\u00a0that\u00a0the\u00a0CPIO\u00a0had\u00a0<\/p>\n
previously\u00a0provided\u00a0him\u00a0the\u00a0desired\u00a0information,\u00a0that\u00a0information\u00a0was\u00a0not\u00a0the\u00a0<\/p>\n

5.      We\u00a0carefully\u00a0examined\u00a0the\u00a0contents\u00a0of\u00a0the\u00a0RTI\u00a0application\u00a0and\u00a0the\u00a0reply\u00a0<\/p>\n
given\u00a0by\u00a0the\u00a0CPIO\u00a0earlier.\u00a0We\u00a0found\u00a0no\u00a0infirmity\u00a0in\u00a0that\u00a0reply.\u00a0The\u00a0information\u00a0<\/p>\n
the\u00a0Appellant\u00a0had\u00a0sought\u00a0obviously\u00a0does\u00a0not\u00a0exist.\u00a0He\u00a0had\u00a0wanted\u00a0a\u00a0copy\u00a0of\u00a0the\u00a0<\/p>\n
order\u00a0by\u00a0which\u00a0the\u00a0DOPT\u00a0had\u00a0dictated\/suggested\/proposed\u00a0to\u00a0the\u00a0UPSC\u00a0for\u00a0<\/p>\n
advising \u00a0 imposition \u00a0 of \u00a0 major \u00a0 penalty \u00a0 on \u00a0 any \u00a0 officer \u00a0 even \u00a0 when \u00a0 the\u00a0<\/p>\n
circumstances\/cases\u00a0had\u00a0not\u00a0been\u00a0notified\u00a0as\u00a0warranting\u00a0imposition\u00a0of\u00a0major\u00a0<\/p>\n
penalty.\u00a0As\u00a0the\u00a0CPIO\u00a0of\u00a0the\u00a0UPSC\u00a0had\u00a0clarified,\u00a0they\u00a0did\u00a0not\u00a0tender\u00a0their\u00a0advice\u00a0<\/p>\n
on \u00a0 the \u00a0 basis \u00a0 of \u00a0 any \u00a0 dictate \u00a0 or \u00a0 suggestion \u00a0 of \u00a0 the \u00a0 DOPT \u00a0 or \u00a0 the \u00a0 executive\u00a0<\/p>\n
government\u00a0but\u00a0in\u00a0terms\u00a0of\u00a0the\u00a0relevant\u00a0Constitutional\u00a0provisions\u00a0and\u00a0as\u00a0per\u00a0<\/p>\n
their\u00a0own\u00a0regulations.\u00a0Since\u00a0no\u00a0such\u00a0order\u00a0exists,\u00a0obviously\u00a0the\u00a0CPIO\u00a0could\u00a0not\u00a0<\/p>\n
have\u00a0provided\u00a0a\u00a0copy\u00a0of\u00a0it.\n<\/p>\n<\/p>\n
6.      There\u00a0is\u00a0no\u00a0merit\u00a0in\u00a0this\u00a0case.\u00a0It\u00a0is\u00a0disposed\u00a0off\u00a0accordingly.<\/p>\n
