Mr.D.Sasikumar                        \t\n\t\t        Government Advocate\n\n:ORDER\n<\/pre>\n<p>\tThis Review Application filed by the petitioner seeking to review the<br \/>\norder passed by this Court in W.P.(MD)No.3977 of 2008 dated 28.04.2008.\n<\/p>\n<p>\t2.The main writ petition was filed by the first respondent in<br \/>\nW.P.(MD)No.3977 of 2008, seeking for a direction to the Deputy Commissioner of<br \/>\nLabour, Dindigul, to dispose of the interim application dated 05.10.2007 in<br \/>\naccordance with law.\n<\/p>\n<p>\t3.In that writ petition, deliberately the first respondent did not implead<br \/>\nthe review petitioner, even though she was the applicant before the Deputy<br \/>\nCommissioner of Labour, Dindigul, in W.C.No.233 of 2005.\n<\/p>\n<p>\t4.In that Workmen&#8217;s Compensation Case, the revision petitioner sought for<br \/>\ncompensation on account of death of her husband Mr.Thondhi on 16.08.2004 when he<br \/>\nwas in the employment of the first respondent.\n<\/p>\n<p>\t5.In the Workmen&#8217;s Compensation Case, a trial was conducted and the Deputy<br \/>\nCommissioner of Labour, Dindigul, has passed an order dated 28.09.2007 and<br \/>\ndirected a compensation of Rs.1,71,664\/- to be paid to the revision petitioner,<br \/>\nout of which, 50% is to be paid by the first respondent and another 50% to be<br \/>\npaid by one N.Govindhan, who was also made a party to the workmen&#8217;s compensation<br \/>\ncase referred to above. The judgment of the Commissioner for Compensation was<br \/>\nnot appealed in terms of Section 30 of the Workmen&#8217;s Compensation Act.\n<\/p>\n<p>\t6.On the contrary, the first respondent had filed a filed very innocuous<br \/>\napplication stating that it is an exparte order and that the same should be set<br \/>\naside.  The Commissioner for Workmen&#8217;s Compensation had not ordered any such<br \/>\nnotice and even the existence of such an application before the Commissioner is<br \/>\ndoubtful.  However, the writ petition was filed seeking for a direction to the<br \/>\nCommissioner to dispose of its interim application allegedly pending before the<br \/>\nDeputy Commissioner of Labour, Dindigul.  In that writ petition for reasons best<br \/>\nknown to the first respondent he had failed make the affected party namely the<br \/>\nrevision petitioner as a party.\n<\/p>\n<p>\t7.On the contrary, the writ petition was disposed of by granting a<br \/>\ndirection to the Commissioner, to decide the same on merits within a period of<br \/>\nsix weeks.  Only notice was given to the learned Additional Government Pleader<br \/>\nand even before any counter affidavit could be filed, the writ petition was<br \/>\ndisposed of at the admission stage itself.\n<\/p>\n<p>\t8.Aggrieved by the said order, the revision petitioner, being the third<br \/>\nparty in the writ petition has filed the present writ petition after obtaining<br \/>\nleave from this Court. The Review application is liable to be allowed on the<br \/>\nfollowing grounds:-\n<\/p>\n<p>\ta) First, the revision petitioner was not made as a party in the writ<br \/>\npetition.  Therefore, no order could have been passed by the learned single<br \/>\nJudge without any notice to the proper authority.\n<\/p>\n<p>\tb) The Deputy Commissioner of Labour is only the authority, but the<br \/>\nbeneficiary before him has not been made as a party.\n<\/p>\n<p>\tc) In any event, the writ petition is disposed of at the admission stage,<br \/>\nwhich is not permissible without any benefit of any counter even by the Deputy<br \/>\nCommissioner of Labour.\n<\/p>\n<p>\td) It is rather unfortunate that the Additional Government Pleader should<br \/>\ntake notice and had not  filed any reply to the contentions raised by the first<br \/>\nrespondent\/writ petitioner.\n<\/p>\n<p>\te) In any event, against the final award passed the Deputy Commissioner of<br \/>\nLabour, a regular appeal lies to the Court under Section 30 of the Workmen&#8217;s<br \/>\nCompensation Act. It is in order to avoid  pre-deposit, the petitioner has taken<br \/>\nthe circuitous of filing the writ petition.\n<\/p>\n<p>\tf) This Court has in more than one writ petition in the matter of<br \/>\nWorkmen&#8217;s Compensation has ordered, that a writ petition is not the remedy and<br \/>\nthe person has to move a regular appeal provided under the Act.\n<\/p>\n<p>\t9.Under such circumstances, the Review Application stands allowed and the<br \/>\norder passed by this Court in W.P.(MD)No.3977 of 2008 dated 28.04.2008 stands is<br \/>\nrecalled with cost of Rs.5,000\/- (Rupees five thousand only) to be paid by the<br \/>\nfirst respondent to the revision petitioner.
