Heard the learned counsel for the appellant. The<\/p>\n
lwappellarit, was the defendant. before the trial Court. The<\/p>\n
V’ “original plaintiff is no more. It was his case, that he<\/p>\n
had eIicroa(:hed on the  property to the extent of 14<\/p>\n
cents of land in Sy.No.3’71\/1A of Shiroor Village<\/p>\n
belonging to the government, about 38 years prior;<\/p>\n
suit and had enclosed the same with a coniipour\ufb01i’ <\/p>\n
and had constructed a house apartfroin pVl1’aer7ii:iin’g,_trees if<\/p>\n
and digging a well and constru’Cted_Alo’ther– <\/p>\n
buildings and it was the the p1.avintiff.””‘tl1at he”?<\/p>\n

 suit was filed seeking to restrain the defendant-<\/p>\n
‘ “‘._appel1ant. herein, from putting up any such construction<\/p>\n
it ” -“and there was an order of temporary injunction granted<\/p>\n
by the trial court in respect of the same. It was the<\/p>\n
plaintiff’ s case that the defendant. had forcibly<\/p>\n

encroached on the suit property and had constructed a
\ntemporary shed. The plaintiff accordingly, had pleaded<\/p>\n
the subsequent events of the defendant having<\/p>\n
eneroached on the suit property. It <\/p>\n

\ntrial court”having the suit, the same was carried<\/p>\n
in appeal uar1.d’ttie ‘appellant made a futile attempt to<\/p>\n
 teiidieit\ufb01eiriderlce hletore the lower appellate court. The<\/p>\n
  court, however, rejected the application<\/p>\n
seeking \u00abproduce evidence and af\ufb01rmed the finding of<\/p>\n
  thee trial court. It is that which is the subject matter of<\/p>\n

framed several substgitiai questions of law. While<\/p>\n
candidly admitting, that there was a lapse on the part of<\/p>\n

that having regard to the  <\/p>\n
