Justice KURIAN JOSEPH\n\n Dated :13\/12\/2006\n\n O R D E R\n                                 KURIAN JOSEPH, J.\n\n                      ----------------------------------------------\n\n                           W.P.(C) No.6355 of 2004\n\n                      ----------------------------------------------\n\n                        Dated 13th    December,  2006.\n\n\n                                   J U D G M E N T\n<\/pre>\n<p>              The   writ   petition   is   filed   mainly   with   the   following<\/p>\n<p>prayers :-\n<\/p>\n<blockquote><p>               (i)       &#8220;Issue     a   writ   of   mandamus   or   other   appropriate   writ,<\/p>\n<p>               order or direction directing the respondents 1 and 2 to provide<\/p>\n<p>               undisturbed   water   supply   to   the   beneficiaries   of   Malathottam<\/p>\n<p>               Drinking Water Project.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>               (ii)      To   issue   a   writ   of   mandamus   or   other   appropriate   writ,<\/p>\n<p>               order   or   direction   directing   the   respondents   1   and   2   to   remit<\/p>\n<p>               the   arrears   of   electricity   charges   in   respect   of   consumer<\/p>\n<p>               No.9907   and   to   continue   to   pay   the   electricity   charges<\/p>\n<p>               promptly.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>               (iii)     To   issue   a   writ   of   mandamus   or   other   appropriate   writ,<\/p>\n<p>               order   or   direction   restraining   the   3rd           respondent   from<\/p>\n<p>               disconnecting the electric supply provided to the 1st respondent<\/p>\n<p>               Panchayat, viz., consumer No.9907.&#8221;<\/p>\n<\/blockquote>\n<p>Since the petitioner has sought for a writ of mandamus, it is  for<\/p>\n<p>the   petitioner  either   to   approach   the   first   respondent   Panchayat<\/p>\n<p>or   the   Government,   since   Panchayat   has   taken   a   stand   that   in<\/p>\n<p>view of Government Circular, the electricity charges are to be paid<\/p>\n<p>by   the   beneficiary   committee.
