Justice J.M.JAMES\n\n Dated :20\/07\/2006\n\n O R D E R\n                           J.M.JAMES, J.\n                             --------------\n                          B.A.4351\/2006\n                           ------------------\n      DATED THIS THE 20TH DAY OF JULY, 2006\n\n\n                             O R D E R\n<\/pre>\n<p>             The petitioner is the second accused, in crime<\/p>\n<p>No.622\/2005   of   Varkala   Police   Station.     The   offence<\/p>\n<p>alleged against him are under Sections 143, 147, 148, 149,<\/p>\n<p>452 and  324 IPC read with Section 149 IPC and also under<\/p>\n<p>Section 27 of the Arms Act.   The petitioner is before this<\/p>\n<p>Court, under Section 438 Cr.P.C., as he apprehends arrest.<\/p>\n<p>      2.     I   heard   the   learned   Public   prosecutor.     The<\/p>\n<p>wound certificate, in respect of the injured, a woman, aged<\/p>\n<p>about 36 years,  is produced before me.  It show that both<\/p>\n<p>the   accused   1   and   2   had   inflicted   cut   injuries   on   her<\/p>\n<p>forearm and left hand,  and because of the injury, tendrons<\/p>\n<p>were   exposed.     The   injured   was   referred   to   Medical<\/p>\n<p>College   hospital,   Thiruvananthapuram,   for   expert<\/p>\n<p>management.  The first accused was arrested and he is on<\/p>\n<p>bail.\n<\/p>\n<p>      3.     Considering the materials on record, I am not<\/p>\n<p>B.A.4351\/2006<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>inclined   to   grant   an   order,   under   Section   438   Cr.P.C.<\/p>\n<p>However,  I direct the petitioner to surrender before the<\/p>\n<p>Investigating   Officer,   on   27.7.2006   between   10.30   a.m<\/p>\n<p>and 11.00 a.m.  The investigating officer shall interrogate<\/p>\n<p>the   petitioner   and   thereafter,   produce   him   before   the<\/p>\n<p>Court below.
