Against them respondent No.1 filed complaint<br \/>\nbefore  the learned Magistrate which was sent for investigation under<br \/>\nsection 156(3) of the Criminal Procedure Code.  In the complaint, it<br \/>\nis alleged, inter alia, that the petitioners are developers.  They<br \/>\nhad put up a scheme of flats in Kalol town.  They had given an<br \/>\nadvertisement promising that the scheme of flats will  have several<br \/>\nfacilities, such as internal road, lighting, telecommunications,<br \/>\nswimming pool, club-house etc.  On the basis of such promise, the<br \/>\ncomplainant was prompted  to purchase one of the units for which he<br \/>\nmade full payment.  However, possession was not given till 9.5.2000<br \/>\nthough such possession of flat was to be given  by 18th<br \/>\nDecember 1999.  Even thereafter, the scheme did not have several<br \/>\nfacilities promised such as, swimming pool,  intercom, club-house<br \/>\netc.  It is thus the case  of  the complainant that the petitioners<br \/>\ncommitted offences punishable under section 406 and 420 read with<br \/>\nsection 114 of the Indian Penal Code.\n<\/p>\n<p>\tThe<br \/>\npolice submitted report dated 23.8.2001 asking for &#8216;C&#8217; summary.  The<br \/>\nlearned Magistrate, however, by his impugned  order dated 12.12.01<br \/>\nordered registration of complaint as summons case  and has issued<br \/>\nprocess against the accused under section 406, 420 and 114 of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>\tThe<br \/>\npetitioners preferred Criminal Revision Application No.44 of 2002<br \/>\nbefore the Sessions Court, which came to be dismissed by the order<br \/>\ndated 15.2.2003, inter alia, on the  ground that  the order under<br \/>\nchallenge  is an interlocutory order.\n<\/p>\n<p>\tCounsel<br \/>\nfor the petitioners submitted that the dispute is purely of civil<br \/>\nnature.   The complainant has already filed  a civil suit.  If at<br \/>\nall, he could have approached the consumer forum and that no offences<br \/>\nare disclosed.  He submitted that all facilities were provided except<br \/>\nswimming pool, that too on account of the resolution passed by the<br \/>\nSociety not to construct the swimming pool due to scarcity of water.<br \/>\n He relied on the following two  decisions :\n<\/p>\n<p>Murari<br \/>\n\tLal Gupta  v. Gopi Singh,  (2005) 13 SCC 699.\n<\/p>\n<p>Order<br \/>\n\tdated 7.5.2009 of this Court  in Criminal Misc. Application No.5868<br \/>\n\tof 2008 with Special Criminal  Application No.1111 of 2008.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the complainant, however, submitted that  attractive<br \/>\nadvertisements were  issued making several promises.  Upon<br \/>\ncompletion, number of facilities were not provided.  The  petitioners<br \/>\nfrom the inception desired  not to fulfill such promises.\n<\/p>\n<p>\tI<br \/>\nhave also heard the learned APP for the State.\n<\/p>\n<p>\tHaving<br \/>\nheard the learned advocates for the parties and having perused the<br \/>\ndocuments on record, I find that  the learned Magistrate  has<br \/>\nexamined all aspects of the matter and passed a discretionary order<br \/>\nto inquire into the allegations  for which process has been issued.<br \/>\nIt cannot be stated that   even if allegations made in the complaint<br \/>\nare taken on face value, it discloses no offence  punishable under<br \/>\nthe Indian Penal Code.  It is true that the complainant has filed a<br \/>\ncivil suit.  That by itself  would not mean  that no offences are<br \/>\ndisclosed. Further, it is the case of the complainant that the<br \/>\npetitioners-builders  though had made number of promises for<br \/>\nproviding facilities,  majority of them were not implemented.<br \/>\nWhether such intention  existed from the outset or whether due to<br \/>\nsome later developments, such promises could not be fulfilled are<br \/>\nquestions of fact which cannot be examined in a quashing petition and<br \/>\nwould depend on the nature of evidence that may be brought on record.<br \/>\nTherefore, no case for quashing is made out.\n<\/p>\n<p>\tThe<br \/>\npetition is therefore dismissed.  Rule is discharged.
