Pandya, learned APP waives service of Rule on behalf of the<br \/>\nopponent.\n<\/p>\n<p>\tHaving<br \/>\nregard to the facts and circumstances of the case, the application is<br \/>\ntaken up for hearing today.\n<\/p>\n<p>\tThis<br \/>\napplication is preferred for modification of orders dated  25.3.2010<br \/>\nand 29.3.2010 passed in Criminal Misc. Application Nos. 2580 of 2010<br \/>\nand 3046 of 2010 respectively.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the applicant submitted that initially, condition was<br \/>\nimposed by this Court on the applicant not to enter village Goraj<br \/>\nduring the pendency of the trial. Learned advocate submitted that no<br \/>\nuntoward incident has taken place in the village Goraj and other<br \/>\naccused of the cross complaint facing charge under Sections 147, 148,<br \/>\n149, 302, 323, 324 and 506[2] of IPC are already residing in village<br \/>\nGoraj. Therefore, condition imposed by this Court not to enter Goraj<br \/>\nduring the pendency of the trial requires to be deleted.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>K.L. Pandya, learned APP appearing for the opponent State while<br \/>\nopposing the application submitted that the applicant is a headstrong<br \/>\n person and considering the detailed report submitted by the Police<br \/>\nInspector, Sanand Police Station, no lenient view be taken in the<br \/>\nmatter and the condition imposed by this Court may not be deleted.\n<\/p>\n<p>\tConsidering<br \/>\nthe rival submissions and on perusal of the application as well as<br \/>\nthe report submitted by the learned APP, I am of the view that since<br \/>\nother accused, who are facing the charge of  Sections 147, 148, 149,<br \/>\n302, 323, 324 and 506[2] of IPC are also permitted to enter the<br \/>\nvillage Goraj, the applicant also deserves to be given similar<br \/>\ntreatment as no untoward incident has taken place as on today.\n<\/p>\n<p>\tIn<br \/>\nview of the above, prayer as set out in the application is granted<br \/>\nand condition no. 5[e] imposed vide order  dated 25.3.2010 passed in<br \/>\nCriminal Misc. Application No. 2580 of 2010 which was subsequently<br \/>\nmodified by order dated 29.3.2010 passed in Criminal Misc.<br \/>\nApplication No. 3046 of 2010 not to enter village Goraj is hereby<br \/>\ndeleted.\n<\/p>\n<p>\tWith<br \/>\nthis observations, the application is allowed to the extent indicated<br \/>\nherein above.
