The<br \/>\nappeal was admitted on the following substantial questions of law;\n<\/p>\n<p>&#8220;(1)Whether the material documentary evidence filed by the plaintiffs-<br \/>\nappellants was ignored by the courts below treating the same as<br \/>\ninadmissible and irrelevant.\n<\/p>\n<p>(2) Whether the courts below were justified to reject the plaintiffs&#8217; case for<br \/>\nwant of proper identification of the land in dispute, even though the<br \/>\ndefendants expressly waived the plea of identifiability of the disputed lane&#8221;.\n<\/p>\n<p>      The plaintiffs, father and son, filed suit no. 224 of 1971 against<br \/>\nSankatha Singh and Bhrigunath Singh, two brothers and sons arrayed as<br \/>\nrespondents nos. 3 to 6 for restraining the defendants from demolishing the<br \/>\nwall shown by letters Cha, Da in the plaint map and from raising any wall on<br \/>\nsouth of the wall shown by letters Cha Da and also from taking possession<br \/>\nof the land which lies to the west of the room shown by letter Ka, Kha, Ga,<br \/>\nGha in the plaint map. They also prayed for demolition of the room which<br \/>\nthe defendants have constructed on the land shown by letters Cha, Ja, Jha,<br \/>\nTa in the plaint map, and for restraining them from raising any further<br \/>\nconstructions on this land.\n<\/p>\n<p><span class=\"hidden_text\">                                                                         2<\/span><\/p>\n<p>        The case of the plaintiff as per plaint was that the defendants<br \/>\nwere not old residents of the village; that the property which is in their<br \/>\npossession belonged to one Devi Singh, who was father-in-law of the<br \/>\ndefendants no. 1 and 2; that after death of Devi Singh and his wife,<br \/>\nhis son Buddhu Singh became owner of the property, which is in<br \/>\npossession of the defendants and the defendants are now residing in<br \/>\nit as licensee of Buddhu Singh; that this property which originally<br \/>\nbelonged to Devi Singh lies to the north of the plaintiff&#8217;s house; that<br \/>\nthe southern boundary of Devi Singh&#8217;s property is shown by letters<br \/>\nKa, Cha in the plaint map; that in this house of Devi Singh<br \/>\nconstructions were on the western side and his Sahan was in the<br \/>\neastern portion; that the defendants no. 1 and 2 wanted to construct a<br \/>\nnew house in the eastern part of the Sahan of Devi Singh and on<br \/>\nadvice of Brahamns they wanted extension of that house to the extent<br \/>\nof 5 Hath towards south; that since the land lying towards south of<br \/>\nthat house belongs to the plaintiffs, the defendants obtained<br \/>\npermission from the plaintiffs to include 5 Haths land in their house on<br \/>\nsouthern side and thus constructed their new house.\n<\/p>\n<p>        Defendant no. 1 and his son defendant no. 6 filed one written<br \/>\nstatement and defendant no. 2 and his son defendant no. 3 also filed<br \/>\nwritten statement. Defendant no. 4 who is son of defendant no. 2, did<br \/>\nnot file any written statement. The contents of both the written<br \/>\nstatements are almost similar. In the written statements the<br \/>\ndefendants admitted that the property which is in their possession,<br \/>\nbelonged to Devi Singh originally, but contended that whereabouts of<br \/>\nBuddhu Singh son of Devi Singh are not known for last 12 years so<br \/>\nthey are now occupying this property as owner by way of adverse<br \/>\npossession.\n<\/p>\n<p>        On the above pleadings of the parties the trial court framed<br \/>\nfollowing issues:\n<\/p>\n<p>        (1)   Whether the plaintiffs are owners in possession of land in<br \/>\nsuit?\n<\/p>\n<p><span class=\"hidden_text\">                                                                        3<\/span><\/p>\n<p>      (2)    Whether the defendants have wrongfully encroached<br \/>\nupon the plaintiffs land in suit?\n<\/p>\n<p>      (3)    Whether the land in suit is property described in the plaint<br \/>\nand is identifiable? If not what is the effect?\n<\/p>\n<pre>      (4)    Whether the suit is within time?\n\n      (5)    To what relief, if any, are the plaintiff is entitled?\n\n<\/pre>\n<p>      Consequently, the trial court held that the defendants had not<br \/>\nencroached upon the plaintiff&#8217;s Sahan and that the plaintiffs were not<br \/>\nthe owners of the disputed land as they could not prove their<br \/>\nownership to the land in suit. In appeal, the lower appellate court<br \/>\nuphold the findings of the trial court. Apart from finding that the<br \/>\nplaintiffs-appellants were not owners of the land lying on west of Devi<br \/>\nSingh&#8217;s house it was found by the first appellate court that the<br \/>\ndefendants-respondents have not wrongfully encroached upon any<br \/>\nportion of the plaintiff&#8217;s house.\n<\/p>\n<p>      The counsel for the appellant submits that both the courts<br \/>\nbelow have given concurrent findings of fact against the appellant.<br \/>\nHowever, he did not argue to make out any case in support of<br \/>\nsubstantial questions of law that material documentary evidence filed<br \/>\nby the plaintiff\/appellant was ignored by the courts below and rejected<br \/>\nhis case for proper identification of land.\n<\/p>\n<p>      In view of the facts and circumstances of this case, the Court is<br \/>\nnot inclined to interfere in concurrent findings of fact recorded by the<br \/>\ncourts below as no substantial question of law arises in this second<br \/>\nappeal from the judgments of the courts below which have recorded<br \/>\nconcurrent findings of fact against the appellant.\n<\/p>\n<p>      The appeal is, accordingly, dismissed.\n<\/p>\n<p>Dated: 26.7.2010<br \/>\nRCT\/-\n<\/p>\n<p><span class=\"hidden_text\"> 4<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Baij Nath Singh vs Sankatha Singh And Others on 26 July, 2010 1 Court No. 1 Second Appeal No. 1736 of 1978 Baij Nath Singh &#8230;&#8230;&#8230;&#8230;.Appellant.
