KRISHNAN, J.\n                   ...........................................\n                M.A.C.A.Nos.386 &amp; 387 OF 2010\n                  .............................................\n              Dated this the 30th day of March, 2010.\n\n                         J U D G M E N T\n<\/pre>\n<p>      Both these appeals are preferred on a common point<\/p>\n<p>against the award passed in O.P.(MV)Nos.833\/2007                           and<\/p>\n<p>322\/2007 of the Claims Tribunal, Pala. The tribunal granted<\/p>\n<p>Rs.18,000\/= as compensation in O.P.(MV)No.833\/2007 and<\/p>\n<p>Rs.34,500\/= in O.P.(MV)No.322\/2007. The question that had<\/p>\n<p>arisen    for  consideration in these                 appeals are      whether<\/p>\n<p>without     proper fitness certificate a vehicle can be plied<\/p>\n<p>and if so, whether it will amount to breach of the policy<\/p>\n<p>conditions and whether it will exonerate the insurance<\/p>\n<p>company from the liability. The matter has been dealt with<\/p>\n<p>in para 8 of the award by the tribunal . The tribunal held that<\/p>\n<p>there is valid permit and registration.<\/p>\n<p>      2. It is contended by the insurance company that there<\/p>\n<p>was no fitness certificate and in the absence of fitness<\/p>\n<p>certificate it has to be held that there is                    violation of the<\/p>\n<p>policy conditions which will entitle the insurance company to<\/p>\n<p>raise    a defence under Section 149 of the M.V.Act.                       The<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nM.A.C.A.Nos.386 &amp; 387 OF 2010<\/p>\n<p>learned counsel also had brought to my notice the decision<\/p>\n<p>of a Division Bench of this Court reported in <a href=\"\/doc\/1163955\/\">Thara v.<\/p>\n<p>Syamala<\/a> (2009 (2) KLT 707).        In that case, the Division<\/p>\n<p>Bench held that &#8220;a goods carriage can be used on the road<\/p>\n<p>for carrying goods only after obtaining permit and use of<\/p>\n<p>vehicle without fitness certificate or permit will entitle<\/p>\n<p>insurer to dishonour liability under policy&#8221;.<\/p>\n<p>      3. So the question to be decided is regarding       the<\/p>\n<p>absence of fitness certificate.    In the tribunal, a petition<\/p>\n<p>was moved for production of the fitness certificate.   But it<\/p>\n<p>was not produced.      The impact of the same       was not<\/p>\n<p>considered by the tribunal.\n<\/p>\n<p>       4. I am conscious of the fact that as per the present<\/p>\n<p>trend of decisions, the insurance company has to produce<\/p>\n<p>documents from the concerned Regional Transport Authority<\/p>\n<p>regarding the     existence or non-existence      of   fitness<\/p>\n<p>certificate. If the owner enters appearance and produces<\/p>\n<p>the same, that     will be   the end of it,  otherwise,   the<\/p>\n<p>insurance company has to take steps and get it produced<\/p>\n<p>before the tribunal. So an opportunity can be given being a<\/p>\n<p><span class=\"hidden_text\">                               : 3 :<\/span><br \/>\nM.A.C.A.Nos.386 &amp; 387 OF 2010<\/p>\n<p>material defence for the insurance company.<\/p>\n<p>     5. Therefore the award under challenge is set aside so<\/p>\n<p>far as it relates to the inter se liability is concerned with a<\/p>\n<p>permission to all concerned to produce documentary as well<\/p>\n<p>as oral evidence in support of      their respective contentions<\/p>\n<p>and then    dispose of the matter in accordance with        law.<\/p>\n<p>Parties are directed to     appear before      the  tribunal on<\/p>\n<p>28.4.2010. If amount is already not disbursed, let that<\/p>\n<p>amount be in court deposit till a final decision is taken in<\/p>\n<p>the matter.\n<\/p>\n<p>     Disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                      M.N.
